In terms of how we deal with S75 & chargeback cases, always chargeback 1st. As it is the quickest outcome for customer. We are very clear on which route we take & that if chargeback fails it will automatically be passed to S75 team to deal with. So customer does not have to do anything unless there is some further paperwork required.
Of course not all banks are equal in how they deal with things & advise customers. 🤷♀️
Some people seem to think that banks should simply go S75 & then if chargeback right take that route internally. Well, if retailer fails to reject & then issues court papers. Who gets them? Not the bank. How would you as a customer in such as case feel?Life in the slow lane1 -
Gosh, it's such a minefield 😯 but the garage will be unable to provide any evidence of making a refund as I've not received a penny! I will now wait and see what the credit card company does in relation to claiming the full amount and wat to thank you both again for your advice and examples which are so helpful!Rescued by MSE! Me again! I have now filed a Section 75 for the recovery of monies paid for a car which proved unroadworthy. The credit card company are questioning the fact that the garage company seem to have been dissolved - they went by a name that included the words "Auto Services" but that company was dissolved in April this year. I cannot find the current name of the company on the Gov.uk site. As I paid the balance of the car by bank transfer to his personal bank account, can a Section 75 be applied to a person or does it have to be against a company? Any advice appreciated!Rescued by MSE! It applies to whoever the credit card company paid the money to. But that's the bank's problem. If the bank gave credit to a company that doesn't even exist any more, then they should be looking harder at their processes,Your claim is against the bank.If it sticks, force it.

Hi born_again, he actually wrote the garage name on the invoice - it was not headed paper.
Hi Ectophile, the £300 was paid on the credit card, the balance paid by bank transfer to his personal bank account.
Even as I type this, I realise just how stupid I have been! In looking for evidence to support my claim, I have found this guy has convictions and suspended prison sentences for selling dangerous unroadworthy vehicles dating back to 1994!! His previous company was dissolved last April and his current company is not registered. I now cannot find his garage on the internet or Facebook so he's probably trading under yet another name!Rescued by MSE!
