All tenants signed tenancy agreements but some of them moved in the building from new when there were no wellbeing charges. They did not sign any agreements, they were not told about them they were just sent an invoice from the date they moved in till the date they received the invoice which was between 5/6 months. How can that we right? Also, the point is, had they have carried out financial impact statements then the service would have been free, as many of the tenants would have fell below the threshold that they were allowed to live on. Council did not ensure that these vulnerable tenants had enough money to live on. Some with dementia, some have limbs missing, some with strokes, list goes on.0

Was the ‘Financial assessment’ carried out (paper exercise) as part of the application process for each flat?0

Update. We have found the document that our Council provided to the Cabinet in 2017. The leadership team came along to a meeting last Wednesday when we presented the information that we had collected on the laws that they had ignore. They were fidgeting in their chairs, colours drained from their faces, when they realised they had been rumbled of their wrong doings.
It is written in the regulations that hey should have carried out Financial Impact Assessments to ensure that they left the tenant with enough money to live on. This should be done before they sign the tenancy to ensure that they can afford to live there. They did not carry out this assessment. Their proposal in 2017 clearly states that they knew this but, were ignoring it. They were charging everyone regardless of the income.
The Council have now employed an outside consultancy firm for consultation going forward on costs. Too little too late for us who have been ripped off, some of whom have been here since January 2022, when the building opened.
We presented the leadership team with a letter quoting the laws they had broken and we asked for a refund. They were openly shocked. The tenants age range 65-92, were also shocked when we gave them a copies of the documents we had uncovered so as they too see the procedures the council should have taken, but decided to ignore. The war is not over yet, but, even if we don't get our refunds it is more important moving forward that other elderly vulnerable tenants do not get ripped off.
Four of the tenants families are up in arms. Two of these have learning difficulties and two with dementia, they are most upset because they thought they were doing right by their relative but to learn of how Adult Social Care have misled them has not only upset them it has caused great anger.0
