    Why do people ask stuff like that when the event hasn't even happened

  • Well because it is a consideration when deciding whether to pay now or more after losing a court case. If POPLA don’t think my argument are valids - why would a judge?

    People who follow advice on this forum font roll over and pay up.
    No evidence you will get a court claim.
    Also no connection between popla decisions and court decisions

    You will never get a summons. This is not a criminal matter.

    No summons, or CCJ risk either.

    People lose at POPLA or IAS then win in court literally all the time here. That's absolutely normal!  We have an evolving Template Defence and we see wins 99% of the time.  Every day.

    But Smart (is it Smart Parking, not APCOA?) have NEVER started a small claim I've seen in fifteen years of doing this. They have no litigation culture.

    If they break the habit of a lifetime we'll help you defend. No risk. People who lose pay less than the claim. We know what we are doing; we are telling you that you won't be sued.

    But if you are, we'd likely see you win. Judges apply the law. POPLA don't.

    Next time don't do an appeal without asking us first. Every PCN could have been knocked down like ninepins.
