Britannia Parking, DCB Legal court claim 2025, WS stage

I strongly suggest that you phone them and find out next week, you are conducting your own case as a Litigant in Person so should be liaising with the court that you nominated
I would have thought that it would be an e-filing address, ( or small claims ), but you are asking us volunteers on a Bank Holiday weekend , instead of asking the actual court staff on a business day, I strongly suggest that you ask the latter, to be sure ( if its not written on your court order ? )2 -
Unfortunately no it is not written on the court order which is really not helpful.
Apologies, I understand your point, of course I plan on contacting the court after the bank holiday weekend but thought you may be able to point me in the right direction before then.
I have managed to find the correct email now from an auto reply I received from the court house general enquiry email.

Glad you found it eventually
There is no way that we could keep track of the thousands of email addresses for the hundreds of courts in the UK !
Just looking at the various websites with contact details could give people a migraine
The paid court staff for each court would be the go to place for correct information, one reason that they have enquiries phone numbers and emails to assist people, as you found out2 -
I'm more concerned that you appear to have ticked 'YES' to Determination Without a Hearing' in your N180?
NONONONO!! Disaster. Absolutely NOT.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I presume it will be too late to have this changed now?Coupon-mad said:I'm more concerned that you appear to have ticked 'YES' to Determination Without a Hearing' in your N180?

Does the court recieve a copy of my defense? Would my witness statement not just be the same as my defence?Gr1pr said:Look up the website for those courts in Birmingham, you want the civil court email for witness statements etc
You email your WS + Exhibits bundle to Bm court plus the lawyers by that deadline you were given , 2 weeks prior to the hearing is the old standard, that evidence will accompany your WS0 -
1) yes, the CNBC in Northampton send everything to your local nominated civil court as part of the processChillitomato said:

2) no , definitely not, your witness statement plus Exhibits bundle will support the defence, not replicate it
BTW , Its Defence, with a C , every time

I don't really know what I could add in my witness statement that would be different from my defence.Gr1pr said:

Also I only really have my bank statement ro provide as evidence, is that sufficient?0 -
Exhibits are evidence, plus your witness statement is an Exhibit too
The newbies sticky thread in announcements gives examples of excellent witness statements by other victims here, I suspect that you have not studied them , they are exemplars of how yours should be
The better the research, the better your case
In simple terms, think about it like this
You were accused of taking an IPAD or IPHONE from the Apple shop in centra London on Boxing day 2024
How do you plead ? NOT guilty your honour !
What is your defence ? It wasn't me, I wasn't there !
What does your signed truthful Witness Statement say and with what Exhibits ( evidence ) to back up your not guilty, not there plea ?
I was on holiday for 14 days in Sharm el Sheik in Egypt from the 20th December 2024 until the 4th January 2025 at the Hotel Seti and attach copies of my bank statement, travel documents, passport stamps , itinerary , hotel safe key contract and pictures of myself taken whilst I was there, I also attach as Exhibit Z a copy of my travel document to see the Valley of the Kings and Luxor. So it definitely wasn't me in the London Apple Outlet
That witness statement expands on the defence, not replicate it, but is a rough and ready analogy which I fully accept ( still half asleep here , others on here could definitely come up with something better )
But you should get the gist
In your case
Britannia Parking state, no valid payment made !
Your defence is, yes I did pay the correct payment ? No breach of the parking contract occurred !
Your witness statement will elaborate on the circumstances, as a first person witness who was present, that you did make a payment, in full , and your Exhibit ABC1 is submitted into evidence as an official Exhibit to prove that Britannia received full payment, ergo no breach of the parking contract ocurred and the claim is false
Personally I expect that the case will be discontinued before the trial fee is required to be paid by the claimant, so will never get to a court hearing4 -
That really helps, thank you. I have also been back to this car park since and the machine is extremely glitchy and hard to use, would it be worth me getting a video of this?Gr1pr said:Exhibits are evidence, plus your witness statement is an Exhibit too

Also, lots of reviews on Google of people having the same issue I had, would it be appropriate to attach some of these reviews?1
