Black Horse - cannot find my agreement!!

Hi,
I am 100% sure I held an agreement with Black Horse during the car finance miss-selling time. I have given them all of my information except the agreement number as I do not have this. I have even shared with them a recipt number and email from settling the finance, and my bank details and statement showing my direct debit coming out.
I requested a 'Data subject access request' that also came back inconclusive. They advised me to contact my (old) bank to see whether they hold the direct debit reference which would be my agreement number, otherwise they cannot help me any further.
What can I do now? Is there a formal complaint process I can go down, as they arn't willing to help until I give them an agreement number although, i have given them so much detail already. I'm stuck between a rock and a hard place, I feel like giving up too much like hard work.

The issue is not about that and the firms followed the FCA rules. The courts have had different interpretations but are still going through the appeals process. It is a matter of legal interpretations rather than misselling that is going on here. What can I do now?you wait.Is there a formal complaint process I can go down, as they arn't willing to help until I give them an agreement number although, i have given them so much detail already. The FCA is aware that firms have correctly destroyed records in accordance with the data protection act and will no doubt address that in its report.
That report is currently scheduled for 2025 but is expected to be pushed back to 2026 or 2027. Until then, there is nothing to do. However, firms that pre-archive data before destroying it may well bring data back onto systems between then.

The same has happened to us. We keep sending details to Black Horse and keep receiving the same letter saying that they need more details.
They're hoping we'll give up."Doing nothing is very difficult..........you never know when you're finished!"0 -
It's funny how people want companies to erase their data when it suits them. Yet cry about it when a free lunch is mentioned.2

Part of the FCA investigation is specifically to look into what to do with people whose documents have long been deleted.Sam Vimes' Boots Theory of Socioeconomic Unfairness:
People are rich because they spend less money. A poor man buys $10 boots that last a season or two before he's walking in wet shoes and has to buy another pair. A rich man buys $50 boots that are made better and give him 10 years of dry feet. The poor man has spent $100 over those 10 years and still has wet feet.

At this time, the FCA has not told consumers or firms what they need to do. This will appear in the report coming next year (or put back to 26 or 27). This will include reference to deletions of data under the data protection act. In the meantime, firms are being inundated with requests from people that are not being patient.
In time, old archived data may well be put back on systems, as the FCA told firms to do with PPI in the end. But firing off prematurely as you are and repeating it is just clogging up the system unnecessarily. Be patient and wait a bit longer.I am an Independent Financial Adviser (IFA). You can log a complaint on your complaint but all complaints are currently frozen until the FCA investigation is complete. The 8 week period for responding to the complaint currently will start in late November 2025 so they have until January 2026 to respond. That said its anticipated the FCA will delay again to wait for the Supreme Court judgement and any date for that to even be heard let alone a judgement issued, hasn't been set so likely to go back significantly.
There will be many who's agreements have been lost given both the amount of time involved and secondly because GDPR came into effect and the FCA without doubt will have to decide what those that have rightfully deleted records will have to do.

Has anyone had an update on the "we can't find your agreement number" response from Black Horse?
I have been getting this for over a year. Apparently the FCA has said its on hold until Sep 25, but I'm struggling to find the elusive agreement number and I know 100% that I had Black Horse Finance, but t was taken out in Sept 2010. I rang the dealer that sold the car and they said they can get the agreement from archive if I have the agreement number, it's the only way they can search for it. This is so frustrating0
