    There are no templates but there are examples in the Successful complaints thread in announcements, have you read that thread, starting at the end and working backwards. ?  I suggest that you do

    Yes they may be the agent who contracted with the parking company on behalf of the landowner

    No they won't be the Landowner, but may know who is 
  • FINALLY got some success in terms of the following reply. Any ideas on how to respond? Shall I start politely or go find blazing?!

    Please send over a copy of the letter and we will look into the detail and get back to you. We are authorised to deal with this on behalf of the landlord as this is a day-to-day matter.

    Sounds good. Politely send them the PCN and the threatening letter (and proof of purchases) and say if they can please cancel this wholly unfair charge, your family will feel safe to return to the retail park.  So far you were all planning on boycotting the place...

  • Ok so latest update is the following, basically telling me to do what I have done already which is to appeal to the parking company. Any ideas on next move?

    Unfortunately, Alder King or our client are unable to intervene in this matter and you should liaise with the party on the correspondence to discuss the matter.

     

    Whilst we appreciate the circumstances of your situation.  However, there is a lot of signage in the car park at the property stating there is a 2 hour stay limit and if your stay was over this is was in contravention of the terms of use of the car park, which the car park management company will enforce. 

     

    I am sorry that we cannot be of further assistance in this matter.

    Say you are astonished at this after a positive first reply, especially given:

    1. The slight delay was caused by one of their stores' card machines failing and thus, the usual mandatory minimum (not maximum) ten minutes grace period was only exceeded by 6 minutes and wasn't the fault of the motorist;

    2.  You have proved you were a genuine shopper, who surely the Retail Park doesn't want to lose and nor do the stores;

    3.  There is no appeal because Civil Enforcement Ltd (aka Creative) are demanding £170 so right now, contacting them is futile for consumers but the case has not reached court stage so can be cancelled easily;

    4.  Surely nobody at Jones Lang Lasalles signed a contract with this notoriously litigious ex-clamper (whose Head of Legal is from discredited and defunct Wonga) that doesn't allow them to cancel a number of PCNs for genuine patrons who the landowner wouldn't wish to see sued?

  • This is brilliant; thank you so much for your time, I should have mentioned that Adam Parker is from JLL who manage the car park opposite the one that was parked in. Adam gave me Simon’s details as the correct retail park’s manager. Simon works for Alder King which makes their association with these parking cowboys even more surprising. Apologies for not mentioning this in the previous post.

    Unfortunately, you will need to liaise with the car park management company to explain your situation and what you believe to be the mitigating factors.  The parking control is clearly stated on the signage in the car park and it is for the users of the car park to adhere to this, as would be the case if parking on a public highway.  We are not able to deal with request for PCN’s to be cancelled.

    Dear Simon,

    This is surprising. There's no appeal that's worth trying.  I'll be sued. Thankyou very much.  We won't return.

    It's sad and disappointing to learn that your company (with a very good reputation) actually has signed a contract with this notoriously litigious ex-clamper (whose Head of Legal is from discredited and defunct Wonga) that doesn't allow your firm to cancel a number of PCNs for genuine patrons who the landowner wouldn't wish to see sued.

    This won't help the site's reputation one jot.

    In your shoes, I'd be recommending your Partnership team to swiftly end this aggressive litigator contract before the Government introduce the new law / statutory Code of Practice, expected in 2025.

    I'm guessing that CEL didn't tell you about that. Thte extortionate amounts demanded and questionable activities of ANPR parking firms is about to be restricted to stop consumer harm like this.  I'd get them out now because - going by online reviews and expert opinion - CEL (aka 'Creative') really isn't expected to last long in a regulated environment and any banned firms won't be able to get DVLA data.

  • When I was looking at their website’s our team page I noticed that their marketing manager was someone I knew so I sent her an email explaining my predicament and she said the following, is this correct re jurisdiction?

    Oh no, sorry to hear about your fine.

     

    I can talk to Simon about it, but I can’t promise anything. I would imagine the issuing and appealing of tickets would be out of AK’s jurisdiction, hence the parking company.
