DCB Legal x Euro Car Parks Limited defence advice

Options
I have been reading a lot of the information on this forum and just need some clarification of which defence template it is to use. I have filed my acknowledgment of service and now just need to put together my defence.

The particulars of the claim:

  1. The Defendant (D) is indebted to the Claimant (C) for a Parking Charge(s) issued to vehicle ****** at ****************
  2. The PCN(s) were issued on **********
  3. The defendant is pursued as the driver of the vehicle for breach of the terms on the signs (the contract). Reason:NO Valid Pay And Display/permit Was Purchased
  4. In the alternative the defendant is pursued as the keeper pursuant to POFA 2012, Schedule 4.

AND THE CLAIMANT CLAIMS

  1. £170 being the total of the PCN(s) and damages.
  2. Interest at a rate of 8% per annum pursuant to s.69 of the County Courts Act 1984 from the date hereof at a daily rate of £.04 until judgment or sooner payment.
  3. Costs and court fees

What is the Issue Date on your Claim Form?

Upon what date did you file an Acknowledgment of Service?
Your MCOL Claim History will have the definitive answer to that.
  • Issue date is 29.10.24 and I filed the acknowledgment of service on 08.11.24

With a Claim Issue Date of 29th October, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 2nd December 2024 to file a Defence.

That's over two weeks away. Plenty of time to produce a Defence but please don't leave it to the last minute.
To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.
Don't miss the deadline for filing a Defence.

Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

What happened to cause the PCN?

Machine & app not working?  Typo in the VRM? Overstay of paid for time?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Yes, that's what I meant. Now corrected. Thanks.

And did you ever appeal and get offered to settle for £20? Or ignored it all?

Didn't appeal but when I originally questioned the fine I was told there would be a £20 administration fee and I refused to pay it

OK, so read a few DCB Legal case defences from this week and copying the style of denying their numbered paragraphs, one by one.
