Excel Parking PCN Crown St Leeds - i paid for parking, admittedly short

i have recently received a PCN. However, i appealed this to Excel parking services before reading any other forums or internet chats. I appealed and provided a redacted copy of my bank account showing payment for my parking. No ticket or receipt was issued when i requested them upon payment, despite subsequent signage showing i should display a ticket (see later comment).

the appeal was rejected on the basis that i paid at the end of my parking, and not within 10 minutes of entering the car park. My payment, upon investigation was short as i assumed that the ANPR was registering my entry time, and upon entering my registration into the machine would present me with the appropriate charge, however that wasnt the reason for the rejection. I have been provided with umpteen signs that are present in the car park etc etc

Do i still hold fire on making payment, or have i admitted liability by confirming i made payment and providing my redacted bank statement?

    You probably confirmed who was driving 

    Excel will demand full payment of the PCN invoice, due to the alleged breach of the parking rules on that private property by the driver 

    We have no intention of telling anyone to pay, for various reasons ( that choice is yours to make, not ours. )

    Obviously you don't pay Excel. Never ever use one of their car parks. Avoid Excel and VCS (and any IPC firm) traps.

    Ignore them.

    Tell them if you move house within SIX YEARS.

    Come back here when you get a court claim.

    That is all.

    1st time and definitely the last time, that i'll be using an Excel car park. I always ask for a receipt when i pay on any car park as i dont trust them as i've been issued with a "fine" elsewhere, but had my ticket & receipt in my car, so just bounced it.

    i still cant believe with this one, that they are using contract law, and that i didnt pay within 10 minutes to fine me, even though i have paid for my parking :)

    Its currently an unregulated industry, complain about the lack of progress at the MHCLG to your local MP 
  • so i've received the "Notice of Debt Recovery" letter this morning, so 14 days to now pay £170, they really are taking the !!!!!! when i paid for parking, but not within the allotted 10 minutes

    it basically says its not subject to high court or bailiff, but they advise commencement of legal action :)

  • Morning all, so i have received the documents from  HM Courts and Tribunal Service

    I have responded to the Acknowledgement of Service this morning as i received it on the 15th Feb, so have done within the 14days

    I'm going to be honest i have tried to follow some of the guidance in the threads but struggled to understand what i should be using in my defence

    I have a photo of the signage, which doesnt state pay and display, with T&C apply in small print on the bottom of the sign. I'm actually back in Leeds this Friday, so going to take another photo in similar light to when i entered the car park last year to show that its difficult to see the small print. The ANPR sign is very visible

    I also have proof of paying for my parking, in form of ticket and receipt but they are using the didnt pay within 10 minutes and breach of contract

    I also cant access Dropbox as i only have access to a work laptop / phone, and for security reasons i cannot access public dropbox sites, so unable to read some of the documents provided

    Can you post image of the PoC on the Claim Form (bottom left) cover your reg no. What is the issue date.

    Have you looked at the Template Defence thread at the top of the forum? The defence is written and advises what you need to add/change. It's very little. No evidence goes in your defence keep it for your witness statement which is submitted later on.
