county court parking fine claim

iv received a court letter for a parking fine i refused to pay because i parked in capital shopping park leckwith cardiff the parking is max 3hrs but the time i went to costco, asda, next and hobby it was about2hrs30mins. That still gave me 30 mins which would be plenty time to get out. but being the 23rd December it took me nearly a hr to get out of the carpark. it was bad enough getting out of my parking space. But they had no remorse about this situation. 
 So it says if i lose the court i will have a CCJ against my name. This is a case of rip off Britain again.
CAN ANYONE ADVISE PLEASE

    Study the second post in the newbies sticky thread in announcements 

    Its a court claim for an outstanding alleged debt due to a Parking Charge Notice that the parking company issued, not a fine 

    1) Name the parking company 

    2) Name the lawyers on the claim form, if used 

    3) Post the issue date from the top right side of the claim form 

    4 Post a redacted picture of the POC on the bottom left of the claim form, after hiding the VRM details first, hide the rest of the claim form too, no personal information

    You would be very very very unlikely  to lose if they were daft enough to go to court, but even if you did, you would only get a CCJ if you did not pay the award against you.  Follow the advice above and complain to your M.P..  
    You never know how far you can go until you go too far.
  • the parking company is Premier Park Limited i think lawyers are Gladstones solicitors Limited and the issue date is 4th Nov 2024

    You need to be aware that those Particulars of Claim are totally inadequate.
    Nowhere in those Particulars is there any explanation of what the driver is alleged to have done wrong.
    This will be an easy win.


    With a Claim Issue Date of 4th November, you have until Monday 25th November to file an Acknowledgment of Service, but there is nothing to be gained by delaying it. 
    To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.
    Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 9th December 2024 to file a Defence.
    That's over three weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service guidance.
    Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.

    That's not true.

    No risk because if you lose in the end, you'd pay less than the claim (no CCJ left at all).

    Defending is dead easy.

    Read some other Gladstones court claim threads to see how others worded their facts paragraph 5.  You'll be using the alternative defence linked in the Template Defence third post, for cases where the breach is not pleaded.

    The only issue you have is Cardiff court, which is terrible and doesn't grant hearings.  They make decisions on the papers only.

    Think about nominating Bristol Court and using a friend's address instead. Not joking.

    Defending is a cinch but you have a crap local court who don't offer hearings.  You must know people in England whose address you can use?
