PCN for disabled RK for extremely short stay

    Add the year the EA came into force, Equality Act 2010.

    State that an occupant of the vehicle has/had a disability at the material and has protected characteristics as defined by the Act. Include a copy of the BB, (both sides but redact the photo).

    Include the date of the alleged event and the PCN number, and request they instruct their sub-contractor to cancel the charge.
    Advise them that they should seek legal advice if they do not understand their legal obligations as required by law should the charge not be cancelled as you reserve the right to join them against them in a counterclaim should Euro Car Parks Limited pursue this matter through the County Court.

     Yes, ensure your MP is made aware of all the facts.

    Location, name of PPC, PCN number, date of incident etcetera. Your name/details etcetera and that you are  acting as advocate/care-giver for this lady.

    Unregulated private parking company is pursuing the registered keeper of a vehicle who was transporting a disabled and terminally ill passenger who needed extra time.
    Breach of the Equality Act 2010.
    Failure to anticipate the needs of a disabled person and failing to make reasonable adjustments for such a person before the event = Indirect Discrimination.
    Failing to make reasonable adjustments once the agent was made aware of the disabled person's needs = Direct Discrimination
    Both indirect and direct discrimination are illegal = 2 Criminal Offence


    This sort of behaviour absolutely disgusts me. The landowner should be ashamed of their actions. The PPC should be ashamed by their actions, but they are not. All the want is money, and they don't care from whom they get it.

    The recipient of the PCN should possibly appeal to ECP, so if that's is the disabled person then they should be doing it in their own name, even if assisted by a good Samaritan

    Given that too much information was redacted and the picture subsequently deleted, its hard to advise you about the PCN itself 

    As for the other question, the recipient of the PCN is reserving the right to counter claim, because everything is done in the name of the person whose name and address are on the PCN

    Yes, that's better wording. As advised above, complaints and appeals must come from/in the name of the person who received the parking charge notice.

    Yes you should appeal, but not until the complaints procedure has been exhausted, or the appeal deadline is imminent.

    The issue date was 30/10/2024.

    Would it be helpful to re upload the PCN? It's hard to know what I should and shouldn't redact to not give or give too much information that seems to be useful.

    No personal information, no VRM details, no reference number, no QR codes, but leaving all dates and times showing, as well as the other parking company details, allegations , timescales etc etc
