County court letter

Good Morning
My Daughter parked in a b&q carpark to eat her Macdonalds in Plymouth it was around 11pm at night. She got the parking fine ( not allowed to park there outside of store opening times) we didn’t appeal in the time frame then it got passed to someone else. I sent emails saying can they provide proof she was parked up and they basically ignored that and said nothing they can do she is on the camera entering and exiting. The second company asked if we wanted to do a pay plan which we didn’t as trying to find out more but then we kind of haven’t done anything until this brown letter has arrived today and I can see it’s from Nottingham court.

I will say she has used the car park before once or twice and has never got a fine so I think they must have changed the rules. It was dark when she was there so doubt she would have even been able to read the signs.
So seeing as we haven't followed any advice from here until this point should we just pay the £175? (started at £60 we didn’t appeal in time I was on holiday she is only 18, then forgot, couldn’t access the website etc then they said too late and fine increased )
Thank you.
Thank you.

Are you sure that its from Nottingham court. ? Or Northampton CNBC. ? More likely to be the latter
Post a redacted picture of the letter, hiding the personal information, such as name and address and the QR code , the reference number, the VRM details, the password etc, but leave the dates showing ( only hiding what I said. )
Name the parking company and location of the incident, plus name any lawyers involved by the parking company too
But no private information, the rules here don't allow private information, plus you dont want the world to know those details1 -
What is the issue date on the top right of the claim form. ?
So its a UKPC claim form using DCB Legal as go betweens
That is an MCOL claim form that came from the CNBC in Northampton. ( Not Nottingham. )
I would assume that they want between £250 and £320. ?
Ps, if your daughter is named as the defendant, she is going to have to deal with it. ( But you can assist her with advice from here, you are in the right place. )1 -
thank you. Yes sorry I got the name wrong as she hadn’t opened it yet when I posted but has now. I will post the full letter covering what you said. I kind of wish we had just paid the £60! I did offer that in the beginning ( probably the wrong move) but they said too late as already passed on.0

Same as all the zillions of other DCB Legal UKPC claim forms.Princesslh said:Just to add the initial letter came from UK parking control then was passed to DCB legal. This is what the court letter says:
Read some DCB Legal claim threads and defend. Costs you nothing and they'll discontinue the claim in 2025. Very easy.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:
Home»Motoring»Parking Tickets Fines & Parking - read the NEWBIES THREAD1 -
I can still see the password on the Claim form above, we didn't need the rest of them ( the claim form should have been redacted exactly like the one in the thread below )
https://forums.moneysavingexpert.com/discussion/6565394/claim-form-dcb-legal/p1
So its UKPC , DCB Legal, issue date of 7th November, claiming around £261 with a spurious £70 debt collectors charge added in. Seems to me that the alleged contravention is based on prohibited acts, no parking contract on offer, just no parking out of hours
Don't let the defendant do the AOS on MCOL yet, not until after Tuesday, so later next week
Your daughter can start drafting her defence based on the template defence by coupon mad in the newbies sticky thread in announcements, second post, plus the first couple of posts in the defence template thread in announcements too
When its drafted, only post the first couple of paragraphs that have been changed, typically paras 2 & 3 , not the rest, so we can add more advice
No need to rush any of this, take your time, both of you, research first1 -
With a Claim Issue Date of 7th November, you have until Tuesday 26th November to file an Acknowledgment of Service. Do not file an Acknowledgment of Service before Tuesday 12th October, but otherwise there is nothing to be gained by delaying it.To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.
Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Tuesday 10th December 2024 to file a Defence. That's over four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute. To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service guidance.Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.
Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.
Everywhere I have written 'you' or 'your' I do of course mean the named Defendant. Everything must be done in the name of the named Defendant.3
