PCP Claim with Blue Motor Finance has court date

I wondered if anyone could help me. I put a PCP claim in with McDermott Smith Law a few years back and finally in June I was told it has been handed to the courts as Blue Motor are contesting they were in the wrong. In July McDermott went into administration 🙈 the new company have sent me back all my files as they are not taking on the case. I just called the court and they said there is a hearing date for March and I need to pay £346 court fees.
Should I pay these and turn up on the day myself knowing that there has been the recent ruling about PCP that may help my case. I guess if I lose I also have to cover their court fees. However I see I have an ATE policy in place as the invoice is in my files. Or should I get a Solicitior, or ask BMF to settle out of court? I’m at a loss as I have no legal experience. Thanks!

What is the basis of your PCP claim? ie what are you claiming that the finance Company have done (or not done)?
  • It’s for the commission that was provided to the car sale company that I was not made aware of.

    Discretionary commission or??

You are aware of the 'big' cases currently ongoing that will mean it's pointless wasting money on a case right now.
  • So can I just drop the case even though I have a curt date for March. I just don’t.need the stress.

You can withdraw from the legal action at any time.   However, you may wish to see if you are on the hook for any exit charges from the claims company.

And next time, be careful before you sign up to these things.
