Land Registry First Registration

Wondering if anyone else has had a similar issue and can give any guidance. 

My offer was first accepted on a house in March, no chain either side do was hoping to be in quickly. Fast forward 8 months and still trying to buy! 

We found out during the process that the sellers didn’t own the bottom of the garden. We have done three different applications to land registry - all rejected until they asked us to apply for first registration. 

The ordinance survey has been completed and LR have said they are happy to proceed with the application. 

Does anyone know how long FR usually takes after this point? My mortgage offer is almost expired and this has been an extremely stressful process - I’m not sure how much longer I can hold on. 

Any advice is much appreciated!

    Hopefully not long, if LR are happy to proceed. Usually expedited cases are dealt with within 10 working days if everything is in order. Not sure if that applies to FR, though they may be some way through the process.

    Expedition and the 10 days aspect do apply to first registrations but it only gets the case to the processing start line. In cases where a bit of land is missing I'm guessing the sellers have applied to register a claim of ownership based on adverse possession. 
    If so then there are 3 key stages after the start line has been crossed - 1. Consideration of the facts as submitted 2. A site visit/survey to check the claimed facts match the reality on the ground and 3. wider checks such as contacting adjoining landowners to see if they consent/object. 
    It reads as if this one may be between 2 and 3 or at the 3 stage but the conveyancer should be able to check and let you know if 3 has been reached and started. Stage 3 checks usually last 15 days if the claimed land was unregistered
    So my advice would be to check and confirm which stage it's at and if notices are now in play when do they expire.

    I had to apply for a new mortgage, but I was drained. I pulled out 2 weeks ago, buying a new house right now.

    Here is a pretty accurate summation of the timelines from HMLR forum, Adam there is super and I recommend starting a thread of your own:

    • Adverse Possession of unregistered land - a claim as to ownership and can often be linked to a house sale/purchase where it's discovered not all of the property is registered. Average wait time before processing starts 14+ months. Three key stages
    1. Consideration of claim [expedited, 2 weeks + x weeks requisitions]
    2. Site visit/Survey and [2 weeks]
    3. Wider checks with neighbouring/affected landowners. [3 weeks]
    Sounds like you've completed stage 2. So stage 3 begins; ask Adam when the notices have been sent and what the deadline is, you'll get Title outcome 2-3 days after the deadline.
