Missing Ebay delivery - Ebay and PayPal won't help

I purchased an item from Ebay and it was delivered by Yodel. The item was left out by my bin even though I had specified for it to only be left with my neighbour if I was out. There was no card left and I only realised it had been delivered when I received an ebay notification.   The parcel wasn't there when I got home in the evening. I first contacted the seller and they contacted yodel who provided the GPS information and the photo showing it left by my bin! The seller said it was delivered to me so refused to help and told me to open a case with ebay. I did this and eBay closed it as the seller had provided tracking information! Ebay told me I need to get a non delivery report from the courier but they are refusing to give it to me and said the seller needs to contact them.
I then opened a case with PayPal but they have spoken to ebay who just confirmed the seller provided tracking information.
I'm disputing if it was delivered, I'm disputing the fact I haven't received it as yodel failed to leave it in a safe place with my neighbour as I had requested.
Whar else can I do? It was £25 so I'm not sure if I can contact the small claims court? Would I open a case against the seller or ebay?

    I would file a complaint with ebay.  The seller might be able to prove the item was delivered - but they can't prove it was delivered to you because it wasn't!
    ebay need to rule against the seller because the seller is responsible for the delivery.  Yodel's contract is with the seller.

    I would say small claims against the seller, have you left them negative feedback ? That may prompt some interest from the seller !.

    It is rare to the point of never happening that ebay will find for a buyer when item is taken after delivery where seller has proof of delivery. in the OP they also say that they have opened a case and already had it closed anyway

    OP probably needs to keep badgering Yodel but may well need the seller's co operation to do that.

  • I feel they will come back and ask you to just report it to the Police as theft, and thats it. As stated above, without the sellers co-operation there's little you can do - I thought it had to be the seller who raises a claim with the courier rather than the buyer, considering the 'service contract' is between the seller and the chosen courier.....

    It's disgraceful how couriers can just leave parcels outside like this and walk away, thinking their job is done. It's getting worse and worse!

    I thought it was up to seller too and Yodel are telling me the same but Ebay are insistent I need to get the non delivery report.   They even gave me the CEO email address and the link to Resolver

    When my RM parcel was delivered to the wrong address last year I had to be very persistent with both RM and eBay. I actually got a written apology from Royal Mail stating that the item had been delivered to the incorrect address but they had been unable to retrieve it and were unable to provide compensation . RM kept saying that only seller could claim, but seller was using business post and had no compensation so it went round in circles.

    ebay said they couldn’t force seller to refund me, seller said he couldn’t refund me as he wouldn’t get compensation and RM said they wouldn’t refund me. In the end after several goes at eBay , and I mean ‘ a lot’ of emails and phone calls EBay refunded me as a goodwill gesture. 

    Completely off topic but I understood to some extent the sellers point of view and even eBay’s POV but it was RM that I thought acted appallingly. They took my item to the wrong address and admitted it in writing, and then said there was nothing they could do about it.

    I would say small claims against the seller, have you left them negative feedback ? That may prompt some interest from the seller !.
    Please don't do that. It will cost more money and there's no certainty you'd win, plus it doesn't appear to be the seller's fault. It costs £35 for a small claim, so you could end up being £60 plus down.
    I'd badger Yodel. Try Twitter or other social media or leave them a review on Trustpilot, it looks like they answer there to negative reviews.

  • I have now been sent a letter from the courier stating they consider the parcel missing and I haven't received it but PayPal have refused my appeal and ebay are saying its PayPal that need to refund me so I am going in circles. I'm not sure what else I can do. I also left the seller negative feedback but this has been removed. 
  • Have you reported the theft to the police?

    At the end of the day, the real guilty party here is whoever stole the parcel from beside your bin. It needs to be recorded as a crime - for all you know, the local police may be on the trail of (or have already apprehended) the thief. And if these crimes are never reported, then there's no incentive for parcel thieves to stop.

    (As an aside, we really need to start installing parcel boxes in houses, in the same way that every house has a letter box which allows letters to be securely delivered).
