BMW Discretionary Commission

I used the MSE tool to reclaim potential discretionary commission on two BMW's that I had PCP contracts for. I have just received emails from BMW Finance for each of the claims with the following wording:

'We can confirm that a fixed commission was paid to the retailer and the interest rate on your agreement was set by us, not the retailer. Therefore we can reassure you the fixed commission had no impact on your interest rate. We will treat the enquiry in relation to the above agreement as closed.'

Should I accept BMW Finance's response as being true since I have no information to prove otherwise, or is it possible that this an attempt to avoid repayment of the commission paid on to the dealership? I guess that I am not the only claimant that has received this response.

    Yes you should, they would not risk millions of pounds in fines from the regulator by lying about it, particularly given no-one knows if they will have to refund anything at all. 

    You may have a separate issue with commission in general, there is a second case open now though it seems to only affect undeclared commission

    You wont have any information to prove otherwise as its well known that BMW didn't use DCA on new vehicles.

    Many thanks for confirming this. Both of my BMW's were new.

    Does the same apply for BMW finance for second hand as well ? In particular BMW motorcycles ?

    I have written to them but just get a weird response.

    There have been some cases where people have been told DCA was on their second hand sale and said it was a BMW dealer.   So, it is possible.
