Problem with faulty shoes?

Hello Folks, just joined and looking for some help please?
Son bought a pair of trainers out of TK Maxx a few weeks ago, has been wearing them a few weeks but they are falling to bits, as in the material where the toe creases up is falling off. I told him to take them back with the receipt as it within 30 days but woman has fobbed him off as said not their responsibility and to take it up with the shoe manufacturer as they have been worn and they won't refund. Tried phoning head office, who said they would email out a complaints form and to send pictures and said it was up to the managers discretion (2 hours as of yet and still no email) The chat ability is only for online orders (they were bought in store) Just feel as if getting fobbed off and any help would be much appreciated
