Amazon third party seller problem

I bought two packs of radiator valves from a third party seller on Amazon.  When the parcel arrived, it only had one pack in it.  Upon checking their reviews, they even send out empty parcels!  Anyway, I raised it with the seller and they didn't respond so Amazon refunded me the missing pack.
Upon closer inspection, the valves they'd sent me were the wrong ones!  So I initiated a return via amazon about 2 weeks ago and Royal Mail collected the parcel from me.  A few days ago the parcel was returned to me, marked 'refused' by the seller.  I contacted the seller who denied it, asked for a photo which I sent them, then stopped communicating with me.
Amazon don't seem to want to help me.  They tell me to contact the seller and don't care that he is not responding. A chat this morning was ended by the Amazon agent as they claimed they'd resolved it and couldn't do anything else but what they'd suggested despite me saying please not to go as I needed more help.
I tried another agent, but they are insisting I initiate a return and don't care that I've already done this and the seller won't accept the parcel.  They've sent me another returns label and insisted that is the only way to proceed.  I feel trapped.
What else can I do?  I'm currently £244.99 out of pocket.  I can do the return again but I really can't see this being a resolution as I believe the third party seller is a scammer.

I would send it back, get proof of doing so then start a chargeback with your bank
  • Not sure what you expect Amazon to do, you didn't buy from them. That's the risk you take with 3rd party sellers and the reason I wouldn't spend any more than a few pounds to a 3rd party seller.

    The Amazon guarantee still applies.

OP- go back to Amazon and be polite but persistent and point out that the Amazon guarantee applies.

Amazon make money from 3rd party sellers, they can't just throw their hands up and refuse to take any responsibility for sales made using their platform.

Really? If a physical market trader rents a pitch from the market it doesn't meant the consumer has a claim against the market if the trader won't play ball....

The two scenarios are completely different. Amazon A-Z covers anything bought on their site regardless of whether it is supplied by Amazon , via FBA or via a third party .

Amazon Marketplace is just like Ebay & business sellers.
Each has it's own additional rules, over & above your consumer rights.
Would need Op to post a link to actual purchase to see where they are based & if any legal rights.

But unclear if the total price of 3 items was £244 or if this was just for one & OP got a refund via Amazon for the missing 2 items.

The total was £489.98 and I was refunded £244.99 for the month part of the order. The remainder £244.99 is from the incorrect item part.

I had thought I was protected. In fact I didn’t realise it was a third party seller. Stupid of me, the page showed a single item which was sold by Amazon, when I changed it to a pack of five it changed to a third party seller and I didn’t notice. But I still thought Amazon would support me and I’ve been shocked by their response. I genuinely thought they were better than this.

After further attempts with Amazon chat they are insisting that I return the parcel to the seller again. I’ve done that, it was collected again by Royal Mail this morning, so I will have to see what happens next. I think as another poster said I will have to go for a chargeback on my credit card if this doesn’t work .

If it is returned as undelivered then I can see chargeback failing as retailer can reject on the grounds of not received.

No S75 cover due to item price. Never mind that it's a marketplace seller, so a break of the creditor/debtor link.
