Update from Mobilize (RCI)

Good afternoon,
Further to our previous communications with you, we wanted to provide you with an update on your Agreement and the relating commission payment.

On 24th September 2024, the Financial Conduct Authority (FCA) announced that they are extending their review into the historical use of Discretionary Commission Arrangements (DCA’s) within the motor finance industry.  The FCA are planning to announce their findings and next steps in May 2025.  Therefore, the temporary rules given to firms to respond to motor finance complaints involving DCA’s are also being extended.

The usual 8-week time period for us to investigate and provide our Final Response Letter which we previously advised you had been paused, has now had the pause extended. This means you may now not receive our Final Response Letter until after 4th December 2025.  Until we issue you with our Final Response Letter, you will not be able to refer your complaint to the Financial Ombudsman Service (FOS).  However, please be assured, we are continuing to investigate your complaint during this period, and we will do so fairly, consistently, and as promptly as we are able. 

Currently, we do not require any additional information from you to support your complaint and we will keep you informed of the progress of our investigation during this time.

Once the pause ends on 4th December 2025, the 8-week time limit will be reinstated unless the FCA provide further instruction.  If we have not already provided you with our Final Response Letter, we will have what remains of the initial 8-week time limit to do so.  After this time, you will then be able to refer your complaint to FOS should you not be satisfied with our response.

Rather than the standard 6 months which you have to refer your complaint to FOS, you will have until 29th July 2026 or 15 months from the date of our Final Response Letter, whichever is later.  The contact details for FOS and your rights to refer your complaint to them will be confirmed in our Final Response Letter.

    Given that recent court decisions are going to appeal at the supreme court, it is expected it will be beyond 2026.
