    Recieved this today in the post. Just double checking.....

    Is this just a copy of what has been sent to Premier Parking Solutions for my reference. I am the Defendant so I have no action to take for the moment.

    It doesn't mean my DQ wasnt recieved - of which I have the automated email reply. So with any luck this will be over in 7 days if they ignore and dont file their DQ??????

    You can tell from your MCOL history that your DQ was 'received'

    Hi there,

    Recieved a text message today to tell me I have my Mediation telephone call tomorrow between 9:30 - 12:30. And to refer to the email/letter with details I must read before the appointment.

    However I have not recieved any email or letter! And I am working which doesnt make it easy to answer phone calls - although I will try.

    Can someone please let me know what to expect from the call and how long it will take? I remember reading somehwere that its a futile phone call and to offer £0 or £5 to settle??

    I have recieved my court date for hearing. 11th September at 10am. Stockport Country Court.

    Have to submit my witness statement by 19th August at 4pm, which I will start to work on and share to the thread for comment.

    Just wanted to ask a couple questions....

    1. The letter states that the court believes the case is suitable for mediation etc etc. I have already had the phone call and both parties could not come to an agreement ( they wouldnt take my £5 offer ), so do I just ignore this mediation process and continue with submitting WS? Will that look bad in front of the judge?

    2. Is there still a chance this doesn't go to court?

    3. I am freelance and if I end up missing a days work as a result of going to court, can I counter claim my day rate? Is there a maximum amount I can claim for and when do I do this?

    Any thoughts or pointers on the WS welcome.

    1. Yes, ignore, you've been through that already. A judge doesn't get any information about the mediation stage - it's confidential to both parties. 

    2. Possibly, but not as certain to discontinue as would a DCB Legal case. 

    3. You can try (have proof of earnings to take with you), but normally it's capped at £95. Show your cost assessment in a separate page attached to your WS.

  • A further question please....

    I am a freelancer in the film industry. I have possible work over the court hearing date. I always knew this might happen as its very hard to predict when work will land.

    Can I delay the hearing date? Or do I just resign myself to missing the work - which will cost me hugely. Far more than the claim, and more than I could possibly file costs for.

    I decided to go through this process as a matter of principle so I am willing to forsake the work for the greater good. But perhaps there is another option????

    If I was to delay, does this effect my chances?

    When you filed your DQ, what dates did you put in to show you were not available?  It is often recommended on the forum to block out whole months and allow for some days either side of flights.
