NTK / PCN from CPS in Scotland - issues


Many thanks to Coupon-mad for the comprehensive FAQ. I’ve just received 2 NTKs from CPS (Complete Parking Services, address in Hessle, IPC member) and I'm pretty clear on writing a modified template complaint, but admittedly sorely tempted to heed lots of other advice and just ignore letters received, given how successful this strategy appears to have been in Scotland for all but compulsive repeat offenders who might be worth chasing to the Small Claims Court!
I’d still be very grateful and appreciative for any thoughts on the following specifics:
• there are two events, dated 3/10 and 10/10/24, at a well-known rural public car park that has only just had signs put up this month (part of an attempt by landowners to discourage fly tipping) after decades of free parking – I believe the landowner is likely to be very supportive of CPS in aggressively pursuing as much revenue as possible, without the sort of business or operational considerations we might expect from retail, hospitality or medical sites
• the first event on 3/10 took place in the daytime and must have been so close to the instigation of the new parking charges that I genuinely missed the sign; certainly there was nothing clear at the entrance (coming off a busy main A-road) – this is a place I have been to hundreds of times over 32 years (not an excuse under normal circumstances I realise)
• the second event on 10/10 took place after 9pm in near total darkness when the entire car park and large sections of roadside verge nearby were completely occupied by hundreds of cars belonging to aurora gazers (like me!) all parked up and milling about this car park; no signs were visible anywhere obvious with lighting and I'd imagine hundreds of people are getting these letters today from the same evening
• no windscreen ticket was given at either time
• NTK letters are dated 17/10 and notice served 2 working days after (21/10), but arrived today (29/10) – and have the standard "must pay £100 within 28 days (reduced to £60 if received within 14 Days) from the date of this Notice"... a highly unreasonable 2 days from receiving the letter to pay the reduced amount, or to lodge an appeal (and preserve the lower amount – "where an appeal is submitted within the 14 day timeframe to pay at the reduced rate, and subsequently rejected, you will have a further 14 days to make payment at the reduced rate")
Taking everything into consideration and above all that we are in Scotland, would you advise writing a complaint (as the keeper with unidentifed driver) or ignoring altogether? There's no email address provided, so presumably any complaint will have to be submitted through CPS' online appeals process?

This is Scotland. You can just ignore private parking charges.

Yes, I was thinking about a minority who have incurred enough PCNs to make it potentially worth the hassle / expense of bringing the issue to sheriff court for a simple procedure or ordinary cause claim.There is no small claims court in Scotland.

You can safely ignore them but things will change next year as Scotland will get 'keeper liability' and a statutory regime (as will E&W).
So, you and your driving family & friends will in future need to pay closer attention to signs on private land and avoid getting these AT ALL. There could be a tsunami of cases taken to court in Scotland all of a sudden once they get the weapon of keeper liability.

Car park charges at this site are very new. Apparently the only way you can pay is online.The company seem to manage quite a large number of sites, mostly in England but a fair number in Scotland.Things that are differerent: draw & drawer, brought & bought, loose & lose, dose & does, payed & paid2
