Personal injury claim

I had an accident last year in November which wasnt my fault , the other insurance company accepted fault but are offering very little money for the injury so i would need to go to court.
how do i start doing this or whats the steps? There are no solicitor involved

    A double decker bus passed the red light and hit the side of me and caused injury to me.
    my phone was also damaged in the accident and they aren’t even replying back to my emails regarding getting it fixed or paying the value of it.
    i have only been offered £1000 for the injuries and when i rejected it on the portal and asked for a higher amount they have stuck with just that amount.
    £1000 is a joke, my phone alone is £1k there is no way i am accepting that.

    So who do you intend suing? If the insurance company is saying no more then you will need to sue the bus company. 

    Phone damaged, repairable? What actual injuries did you sustain? You will need to quantify your actual losses, not just say £1000 isn't enough.

    Were you in your own vehicle?

    Well yes i plan on taking the insurance company to court..
    my phone doesn’t turn on at all , i have taken it to a couple phone shops and they couldn’t fix it..
    Yes i know i will need to list my loses and will do that for the court no worries and yes i was in my own car.
    my main concern is where do i apply to take them to court.

    A lot more info is needed. You cant just decide to take them to court. Its not that simple.

    What injuries did you have? Did you need medical attention? 

    You have to prove your losses, you cant just say your phone wont turn on. It is 11 months ago! Was there a lot of damage to the car, how did the phone get damaged?

    What provable losses are you claiming for?

    Litigation is against the driver or the bus company, the insurer will respond to it. 

    You dont mention what injuries you sustained, most modest RTAs result in soft tissue injuries which now are a fixed tariff so easy to look up what the payment due is. 

    For the phone... have you gotten a report on it to confirm the damage was caused by the collision along with a value of it as a secondhand phone with whatever pre-accident condition it was in -v- the cost of repair?

    Your own motor insurance should be handling the claim shouldn't they?  How old was the phone?

    If they have Legal Expenses cover then they would appoint someone to deal with uninsured losses which would certainly be the injury. 

    The phone depends, most Motor does include a token amount for personal effects in the vehicle, some limit it to only theft, some are as low as £100 but some are higher so the phone could go either way depending on the quality of the product.
