  • Final reminder received from DCB Ltd (not DCB Legal) dated 3 weeks after the Notice of Debt Recovery. Filing away and ignoring.

    @Coupon-mad, the NTK that I have received is the Britannia parking one containing a POFA paragraph.

    What does the existence of POFA on the NTK imply?

    Where does this leave me?
  • Hi everyone, I’m new here. 
    I have a question but not sure whether to pay or not. 

    I parked in the dr’s car park to go to the pharmacy. The car park is for use of the dr’s + staff, patients and pharmacy customers and staff. They had just introduced a parking system in the dr’s surgery and a screen/tablet to authorise your stay. There is small written signs in the dr’s waiting area and another on a notice board in the chemist. The dr’s close their doors to the tablets at 6pm ish and the pharmacy is open till 9pm. The pharmacy has no tablets to sign in and they are always running behind with serving patients. They are always under staffed and sometimes get the prescription wrong. In the days of Mon-Fri you can use the car park without signing in for 15 minutes and sat-sun for 25 minutes. The pharmacy is well over 15 minutes every time. 

    I am so bad at seeing close up anyway and on the day I went to the pharmacy with my dad to pick his prescription up  and I knew the prescription was done because I got a text message saying it was ready. 
    I got in the chemist and I could see a piece of paper on the notice board but I couldn’t read it and I had only popped in there quickly so never took my glasses. The pharmacy gave me the medicine and I went back to the car. My dad told me to check it all was there but it wasn’t. So I went back in and they then said I will have to wait for it. I waited 20 minutes and then went home. 

    2 weeks later I got a letter from Parking eye saying I was parked for longer than my 15 minute stay in the car park therefore I have to pay £60. I went straight to the pharmacy and questioned them on this ticket. They said this is the dr’s surgery issue. I walked into the dr’s and questioned the staff at the desk. They said it was nothing to do with them and I have to deal with Parking eye now. 
    The dr’s got Parking eye in because people were parking and going into town and not paying for parking in the paying car parks. 
    I appealed saying the signs aren’t clear enough to see and myself and my dad are disabled with blue badges parked in a disabled bay. They turned me down saying this doesn’t make me exempt as I still wasn’t authorised to park there for that long. They eventually said I could pay £20. 
    My dad got angry and said we should go to CAB. I got an appointment and was advised to pay the £20 but my dad said let them take you to court. 
    I went down the popla route to state that I am disabled and it takes me some time to get from the car park to the dr’s desk which is a challenge on a bad day and that the time we are allowed to park for is too short. 
    I was in the process of emailing everything and my bt email stopped working. I couldn’t sort my popla case out nor could I get emails to the parking eye people. The next month I got a DCBL letter telling me I owe £170. I was still having issues with my email for nearly 3 months. When I did get my email sorted with bt I started getting threatening letters from DCBL. I still haven’t been able to email these people as the email won’t go through and I’m not very good at talking on the phone. Do any of you know what I should do. Do I pay or do I ignore.

    Ignore DCB Ltd £170 demand letters.

    Respond when you get the DCB Legal Letter before Claim.  Or a claim form. When either if those arrives, start a new thread of your own.

  • Another final debt recovery notice came 4 days ago. Ignoring.

    DCBL now recommending legal action to the parking company.

    Notice of Intended Legal Action Received today, dated from Friday. Ignoring.

    I actually managed to leverage some connection with the land occupier. They have a process for canceling parking charges. They now have a copy of the "Final Reminder", which is the form they requested from me. I will chase them up this week to see if anything's been done with this copy.

    Is there a PONR with regards to landowner cancellation? If I were to end up in court, would the landowner not be able to do anything about it at that point?

    Probably not, which is why you must push for resolution now.  Less hassle if it's cancelled!

    Is there a similar amount of time between Notice of Intended Legal Action and receiving a summons?

    You will never get a summons, LOL!

    They have six years to sue in this country. Probably never will.

    They certainly never will, if you get it cancelled by the landowner.
