Landlord not returning deposit after not protecting it properly

    If it really is in a scheme then you and the landlord have to agree a payment before they will pay it out to him - that's the whole point of the protection. If you don't agree then there's some sort of arbitration ( sorry don't know details I've not had to suffer it, my departing tenant agreed the amount i wanted to charge her, they scheme paid us each the agreed percentage)

    Hi everyone,

    So reached out to the schemes and one has come back with the certificates for all three years so it was protected, however we never received any communication on this - which I believe they're also required to do by law? Advice on this seems a bit vague as anything I can find is about if they never protected it at all, rather than if they did but never gave any information on it. 

    At this point, I just want my deposit back and to not also owe them an extra £1k on top for fair wear and tear (which I would dispute in the scheme). Shelter seems to suggest I can tell them they didn't give me the information and to return my deposit in full or I could take them to court? 
    Dispute the full amount with the scheme, but make the LL aware you have sought guidance from shelter and that because they didn't pass on the protected scheme information in years 1&2 you would like the full deposit back.
