New Car ordered but delivery is delayed (HELP)

Hi All,

I ordered a new car on PCP back in March knowing that my current PCP ends in November. When speaking to the dealership I made it very clear (I have email correspondence to prove if this is needed in the future) that I need my new car within 7 days either side of my current car ending otherwise I will be without a car.

We worked together to make sure I chose a car that will be ready come November.

I have just been informed today that the car will not be here when predicted and there is no firm date of when It will be ready.

I am unable to continue my current car as I don't have the ££££ to buy the end of lease valuation and Stellantis (The finance company) are unwilling to extend the PCP unless its in 12 month blocks.

My question is.. can I cancel the order of the new car with no cost to myself and get my deposit back? I am cancelling because they haven't upheld their side of the agreement and I could use the deposit (£5000) to buy a Used car instead.

as it stands now I will be without a car come second week in November and any money I have to get a car in the interim is tied up in waiting for the new purchase.

Sorry if this is a ramble, I'm a bit miffed and concerned

    What does your contract say? Your cancellation rights will be in there.

    Have you actually spoken to the dealer to see what they can do? Sometimes they can offer something to fill the gap.

    You can certainly push for a refund if they don't even have a date for the new car. There's hopefully a clause in the contract.

    You always see if they can change the order to something else that will be available or is already in stock, even if it's used. Or are you wanting to go for something much cheaper that may not be in used stock?

    Have you asked the Dealer whether they have a loan car they can make available for you?

    The small print might be key - there's often clauses to cover 'force majeure' where it is outside the dealer's control

    Can you afford to pay the GFV on your current deal?
    Then when your new car turns up, sell the old and hopefully get the value of the GFV back.

    Maybe the dealer can help with the last part, they might agree to buy it and cover the cost of the GFV.
  • Speak to the dealer to establish what options you have. 

    I ordered a car last year which was delayed because it was sat on a ship in the middle of the ocean. Dealer phoned to update me and gave me the option to continue or cancel and they would refund the deposit in full.

    If you cancel what is your plan for another car, given you can not afford the balloon payment?

    As others talk to the dealer, between you you should be able to work out something that works for both of you.

    If you can get away with cancelling this and getting a refund, then I would say absolutely do this as it gets you off the finance treadmill. You will then be able to set money aside while you have the used car your would use that deposit to buy, in order to ensure that in years to come when that needs replacing you are able to do it outright without needing finance again. 

    It sounds like you were extremely clear about the delivery date being critical, so hopefully they will do the decent thing.

    Thank you for the reply, The contract says that if the car is delayed 60 days or more I can request, in writing, cancellation within 7 days.

    I spoke to them this morning and they said that the car has not even been built yet and then takes 4-6 weeks to deliver.. which is 14th Jan if it was built today. And not quite 60 days.. i have kind of been fobbed off as the dealer is saying they will get back to me with options.
