    Had the call. They offered £210 as the lowest and i offered £10 which they refused. Will go onto next stage i guess

    Had a letter through today setting the court date. I now need to sort out the witness statement part.

    Yes, and as it's Excel I would expect a hearing. DCB Legal rarely discontinue Excel cases.

    DCB legal just called offering a settlement of £201 and asking why i won't accept.

    Signs are clear and its my issue i didn't see them

    They had their chances at mediation 

    Now it's a game of chicken,  who blinks first 

    Nobody here would tell you to settle unless it was £20 or less, just to get it over with 

    Or front it out until the hearing date

    I have now blocked them. Now to read the witness statement prep. I need to get this sorted as im on holiday at the end of this month.

    I need to work out how i defend the pointds raised in the defence- esp around the inflated values.

    We don't know what you ended up putting as you showed us several versions of your paragraph 3. Did you admit to driving? Personally I would (and forget POFA) because you are likely to have a hearing v Excel in front of a judge. Be an honest witness.

    You'll (hopefully) already know how to do a WS and which exhibits to use because this is covered in the Witness Statement & evidence section of the second post of the NEWBIES thread. A carefully put together list of evidence is listed there. This isn't new.

    I did yes.


    3.1 The driver, at the time of the incident, was visiting the Argos store to pick up a collection, located opposite to where the vehicle was parked. The vehicle was parked for 17 minutes in total.

     

    3.2 The driver did not observe signage on entering the car park. On being issued a PCN posted on the 16/07/2024 and received on the 18/07/2024 the defendant visited the car park and noted only one entrance sign on the entrance.


    3.3 The driver did not observe any clearly visible signage detailing the terms and conditions of car park use near the vehicle's parked location. The lack of clear, prominent, and adequate signage led to an unawareness of any parking restrictions, meaning no contract was formed.
