Update: I have now received a debt recovery letter from Trace Debt Management asking for £170. This seems to be different than Gladstones and I am wondering if I should panic now?
No. There's no point in this whole scam when you panic. You were expecting tedious set of £170 threatogram letters, surely?

Re-read the 4th post of the NEWBIES thread to see laughable pics of letters to ignore.  We don't need to hear about Trace letters please.

Also search the forum for Moorside Legal claim and be ready for what happens next.

Keeping the forum updated, I have finally received something called 'Letter of Claim'. I am figuring out next steps.

Going through the forum, I understand that I need to respond with the following text:

    -----------------

    Dear Sirs,

    Ref. ############
    Proposed Legal Proceedings
    Claimant: xxxxxx xxxxxxxx Ltd

I refer to your your letter of claim.

I confirm that my address for service for the time being - assuming you don't faff about and delay any claim - is as follows, and any older address must be erased from your records:
    [Correct address here]

The alleged debt is disputed and any court proceedings will be vigorously defended.

I am sourcing and seeking independent debt advice and as such, I formally request that this matter be put on hold for an additional 30 days, in accordance with the Pre-Action Protocol for Debt Claims 2017 ('the PAP').

I note that the amount being claimed has increased by a hugely exaggerated amount which the Government called "extorting money from motorists".

Don't send me your usual blather about that.
I have two questions, and under the PAP I am entitled to specific answers:

    1. Am I to understand that the additional £70 represents what you lot dress up as a 'Debt Recovery' fee, and if so, is this nett or inclusive of VAT? If the latter, would you kindly explain why I am being asked to pay the operator’s VAT?

    2. With regard to the principal alleged PCN sum: Is this damages, or will it be pleaded as consideration for parking?

    Yours faithfully

    -----------------

I am planning to send this response over email. Would someone be kindly able to confirm that this is indeed the right step?

I would like to bring it back to the attention of forumites that I have no excuse for getting the tickets, I parked assuming that nothing would happen, and by the time the first letter arrived I had already parked the second time.

@Coupon-mad bringing this thread to your attention again. As described at the time of creating the post, I have no valid reason to have parked there. I want to start working on my defence template early and I was wondering what should I do since there is no personal story / evidence applicable for my case. Thank you so much for your time.

But if you had searched the forum for Moorside Legal claim to get ready for what happens next, you'd see no facts are needed.

It has been a long while but I haven't received any letters about the court claim from Moorside legal yet.

You would have expected to. Are you sure they have your correct address ONLY? As long as they don't hold an old address just wait to fight your battle.

And... join us in the war, please:

    FIGHTBACK ALERT:

Please do the government's Public Consultation. We need every poster to complete this vital survey before the deadline.

    See this thread:

    https://forums.moneysavingexpert.com/discussion/6617396/parking-code-of-practice-consultation-now-extended-closes-friday-26th-september/p1

We understand that you may need some pointers. It looks laborious, we get that. It doesn't matter; no knowledge is needed except re your own experiences so you can call out a scam industry and you'll protect millions of motorists and help change the law.

I've written some guidance to help focus new posters on the issues. I've covered almost every question, providing ideas if you agree with our stance on things like DRFs, which we say must be banned.

Ordinary people like you are falling victim to this scam 15 million times per annum. Motorists need your voice added please.

    CLOSES ON FRIDAY 26th SEPTEMBER.

I think I have messed up. I had emailed them to put the case on hold for 30 days while I prepare for defence. But I did not reply to their letter of claim with a defence.
@Coupon-mad what do I do now? I am so stressed.

Did you receive the Claim Form and pack from Civil National Business Centre (CNBC) in Northampton?

You don't reply to a letter of claim with a defence.  You use the reply in the NEWBIE sticky.  Your defence comes into play when you receive a N1SDT claim form from CNBC; have you received such?
