Napier Parking FCN NTK Overstay - Appeal?

Hi guys,

We have received a FCN NTK letter from Napier Parking due to overstaying 22 minutes. I have no excuse other than having a nightmare with my kids at the time as a healthcare appointment ran over and I couldn't get us back to the carpark in time.

The letter came to our old address so I am now outside their 21 day period to appeal, and I am unsure if I have any solid ground to appeal this on.

My main question here is, is it worth appealing this with no valid excuse other than personal reasons? I have previously won a claim but this had some good grounds to stand on regarding inadequate signage etc.

I'm currently being asked to pay £100, I don't have £100 spare, but being an overstretched parent trying to make ends meet I am debating paying as I remember the last claim being very time-consuming and stressful, something I would gladly take on if I wasn't so time poor right now but I'm weighing this up.

Thanks in advance you lovely lot!

Even if you did appeal, it will be rejected, especially because your story appears to indicate that the PCN was issued correctly.  Excuses dont win these cases, especially on pay to park car parks

Nobody is telling you to pay, but it's not an easy ride and may end in a court claim, just so you are aware

The lesson for the future is, pay for a longer period, assume that things will go wrong and build in a contingency

    No point appealing or paying.

Ignore Napier except to email their DPO to tell them to ERASE the old address and note the correct address for service of letters. That is all.  This is not stressful and private PCNs do not need or deserve to be paid, all the time that the rogue industry ducks being regulated by the Government.

Regardless of the reason for the PCN, this 'cowboy' industry are out of control and have made their bed and must get used to being completely ignored by right-thinking people for trying to get £100 from motorists.  Errr...no.

Napier are no longer particularly litigious, so all you are likely to get is threatograms but you MUST get them to erase the old address, so you can be certain that each letter is just a daft joke DRA red screamy font one. Laugh at those.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
