    I would have also argued no contract was formed in the first place. You can bring this in at the hearing by expanding on the point that you left ie. no payment could be taken and because you left, no contract was formed in the first place (see offer, consideration, acceptance). The chain of events from a contract law perspective is no different from reading the sign, declining the offer and leaving.

    That’s all for the advise - I resubmitted with the correction and also called to let them know and they made a note. 

    What is the likelihood now of them discontinuing the case before the hearing? And if they do am I within my rights to requests costs on the grounds of unreasonable behaviour since I’ve already spent a considerable amount of time compiling the evidence and witness statement? They have until 14th Feb to pay the court fee according to the papers I received
