Debt Recovery Plus Text 07/10/2024

Options
Summary below:
I received a text from DRP on a PCN overdue - (overstayed at Millennium Leisure Park Greenwich)
PCN was issued late August 2023 and I moved early 2023. Both V5 and driving license was updated at similar time.
I am a little afraid to pass on my current address to DRP so I replied by text 08.10.24 (did not call) to DRP the following.
______________________________
To whom it may concern,
I can confirm that this is the first time I have seen this PCN (reference xxx), I have moved since early 2023 and updated DVLA of the address change at a similar time. Please erase any old address associated with this car registration.
As this PCN originated from Horizon Parking (BPA registered), the new BPA CoP from Feb 2024 requires a fresh PCN to be issued to the RIGHT address (at the original rate/discount/appeal deadline) so that the keeper may pay, appeal or pass it to the driver. Please forward this message to Horizon Parking so the PCN (reference xxx) can be issued to the RIGHT address.
Happy to provide proof of the current address once this has been passed to Horizon Parking. Thank you.

It was later suggested that both DRP and Horizon email the following.

Dear Sirs,

I can confirm that this is the first time I have seen this PCN (DRP reference xxx), I have moved since early 2023 and updated DVLA of the address change at a similar time. I don't understand how you would still have my old address as it was updated. This is very concerning how your company handles the data extracted from DVLA.

Please ERASE any old address associated with this car registration.

Here is my current address.

They cannot go back to the DVLA database for a second time, or more than once per incident, so that is why they have your old address that was on the DVLA database at the time of the look up

So I suggest that you modify the letter accordingly, mentioning that its a Data Rectification Notice and they MUST ERASE your old address from their records.  Email it to the DPO at Horizon and cc DRP LTD, plus your own email address too, all at the same time

You need both parties to be only using your current address. You need to be aware of anything they are sending you. Anything DRP sends, you can ignore. If any court claim is to be made, it will be via a firm of solicitors instructed only by Horizon. You definitely don't want a court claim going to a former address - major risk of a default CCJ and harmful damage to your creditworthiness. There are no advantages in 'hiding' behind a vacated address.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

This PCN is over a year and only getting a notification on this in October 2024 is unacceptable. As this PCN originated from Horizon Parking (BPA registered), the new BPA CoP from Feb 2024 requires a fresh PCN to be issued to the RIGHT address (at the original rate/discount/appeal deadline) so that the keeper may pay, appeal or pass it to the driver. Yep - all good - then separately email Horizon a complaint and data rectification notice too.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Your fault for responding to a useless DRA. Block their number. Never, ever, ever, ever, ever, and I stress... EVER communicate with the likes of DRP or any other DRA. They are powerless and can be safely ignored.

Your problem now is that you did communicate with DRP when you should have been communicating with the principal, not their 'no-win, no-fee' vermin. You have been marked asa "mug" by DRP and they will be circulating your data amongst their scamming friends.

Your data rectification notice is to the Horizon DPO and you should e "instructing" them to erase your old address and that they, as the organ grinder, should also get all their monkeys that may have been given your data by them to also rectify the data. Going about this !!!!!!-faced and assuming that DRP are the lead, is wrong and likely to lead to an even bigger potential PITA.

I blocked the numbers now, but I am guessing I will receive more from others. Lesson learnt
