DCB Legal/UKPC - Letter of Claim



Hello and thank you in advance for all the advice. 

I’ve received this letter of claim from DCB Legal for overstaying on a retail car park managed by UK Parking Control Limited.

I’ve read through the relevant threads and got a bit confused whether to start with writing an angry email to DCB Legal demanding they leave it or to ask them to hold off for 30 days as I am requesting SAR.

    Hello and welcome.

    The first few lines of the second post in the NEWBIES thread offer good guidance on how to respond to a Letter of Claim.

    Do not submit a Subject Access Request at this time.

    it’s DCB Legal/Euro Car Parks ticket issued for Leaving the site. I submitted my defence neither confirming nor denying that I left the premises but as a response they sent me the following: 

    Good morning,


    Having reviewed the content of your defence, we write to inform you that our client intends to proceed with the claim. In due course, the Court will direct both parties to each file a directions questionnaire. In preparation for that, please find attached a copy of the Claimant's, which we confirm has been filed with the Court. Without Prejudice to the above, in order to assist the Court in achieving its overriding objective, our client may be prepared to settle this case - in the event you wish to discuss settlement, please call us on 0203 434 0433 within 7 days and make immediate reference to this correspondence. If you have provided an email address within your Defence, we intend to use it for service of documents (usually in PDF format) hereon in pursuant to PD 6A (4.1)(2)(c). Please advise whether there are any limitations to this (for example, the format in which documents are to be sent and the maximum size of attachments that may be received). Unless you advise otherwise, we will assume not.

    Do neither.  Just attend the mediation call and offer ZERO, do nit be bullied by the mediator into offering a penny.

    Then DCB Legal will discontinue around Witness Statement stage this winter.  It's a game of poker. Play the game!

    Sorry, I have another question. I have yet another PCN that has just arrived from Parking Collection Services (BPA). Is it worth appealing to them straight away or just wait and see if they it goes to debt collection?

    Appeal it, as explained in the newbies sticky thread in announcements, first post 

    PS,  PCS is DRP LTD, not the parking company 
  • Thank you, it’s a private car park at a block of flats. I am trying to find a landowner but there is only a company address. I doubt they would even bother looking at it. 

    I looked through the Newbies thread and cant’t find a template for the appeal. Would you point me to it please?

    Without knowing the name of the parking company its difficult to advise you, but there is a blue text template for the initial appeal , its very hard to believe that you didn't see it or read that section , especially after you receiving all these different charges

    Trying to progress three PCNs from three different parking companies in a single thread is surely going to lead to confusion.
