    I thought I would share post hearing yesterday. CE didn't show, only sent a generic email to say they wouldn't be attending and CPR 1.1 should be considered. 

    The Judge seemed OK and summarised my documentation well. Evidence was well laid out in chronological order which was easy to follow from the WS.  CE's admission there was 23 months between address check and service, was enough to grant the set aside against 13.2 and award costs fairly promptly. 

    However, I didn't manage to get the case struck out as I was told I didn't ask for it in my application and I can't subsequently ask for it in the skeleton. Is "the application" specifically the N244 form and not the WS? As it was in the latter but not the N244 form. Have I messed up here? 

    I was then told the claim would therefore survive and I should now consider myself served and have 21 days to file a defence. 

    On the whole a good result, many thanks for your help @Coupon-mad

    Assume I now go back round the loop but send my defence to the district court rather than the CNBC?

    Very good and you got your costs too (I think the judge was wrong if it was in your WS and draft order, but never mind).

    Now to use the template defence, the only difference being - as you say - you are not dealing AT ALL with the CNBC of course.

    How was the hearing? I have mine tomorrow, I have followed the guides here and coupon mad has been super helpful. 

    If I bring my partner can they speak to me during the hearing in case I don’t correctly mention something? 

    Did you have to do a lot of talking, I am nervous and excited to hopefully be at the end of it. 

    Mine is in Lewes if this makes any difference to what the judge might agree to.

    Good to see the WS & Skelton are helping others. 

    Further update: - Following the hearing I was sent a Judgment of Order from the court. The deadline for the defence was 2 weeks earlier than I was told in court, so the template was amended and sent to the court and the legal team fairly pronto. 

    On the order it states that CE are to pay my costs by 4pm on the 27th of May. 

    When I emailed my defence I provided my payment details. CE's response was they have not received any order.

    I also haven't received their directions questionnaire (due 2 days ago), so it seems they have missed all the deadlines on the order and are refusing to acknowledge it.

    Send them the Order and tell them you'll send DCB Ltd to their offices if they fail to immediately pay the sum the court ordered.

    Please show us the Order.
