Involved in an accident with an Uber driver and their customer

It would be a claim for negligence against the driver who was to blame for the accident (probably the OP from the description). Nothing to do with contacts.bryanb said:

From the OP's description of what happened it's the OP's fault, not the Uber driver's. On what grounds would the passenger Claim from Uber? (Even if they did, it's the OP's insurer who would end up paying)bryanb said:Surely the passenger would claim from Uber?
Agree OP would end up responsible.0 -
@bryanb - What's his contract with Uber got to do with the OP's negligence?
I don't think you can argue that Uber has broken any contract terms by "letting" the OP hit the Uber vehicle. Which is what I understand has happened here - the OP drove out of a side road turning right onto a main road and he collided with the Uber which was coming from the right on the main road. The OP should have seen it and shouldn't have left the side road.
The Uber passenger sues the OP for his negligence in exiting in front of the Uber. Any contract with Uber is irrelevant0 -
You pulled out into the path of an oncoming vehicle, which couldn't miss you.
Give the driver your insurance details.
It's up to them as to whether they claim or not, and it's up to your insurer to pay it if they find it reasonable.0 -
Just report it to your insurance company, but make no claim yourself. Then just keep your notes of what happened & dashcam footage safe somewhere and get on with your life. You can't go more than a few minutes nowadays without seeing on t'interweb/hearing on the wireless/seeing a poster/getting an unsolicited phone call from an Ambulance Chaser offering Free Money from Compo. "Have you been injured in an accident that wasn't your fault?- FREE MONEY!!!!!".I doubt if Ladbrokes would even offer odds on the passenger making an injury claim, and when/if they do, you want your insurer to have your back.I want to go back to The Olden Days, when every single thing that I can think of was better.....

I wonder which of the OP's cars was being driven? Before you waste too much time on advising them, do check their posting history!

Settled privately but agreed to report to insurance with no claim damage.0

How will you resolve if there is a delayed personal injury claim from the passenger?0 -
Don't accept liability without your insurers consentraptor2004 said:Settled privately but agreed to report to insurance with no claim damage.0
