Looking for help.
I know there's a lot said here on this topic, but I'm dyslexic and struggle to read all comments.
I have recieved a PCN from Amtrac for parking at Stennak car park in St Ives. 2 weeks after my holiday there.
I'm 99.999 certain I committed no crime.
I strongly recall entering the car park, driving round once before the finding a space right at the back of the car park area. I purchased a ticket at their machine (cash for 4 hours) then displayed it clearly on the dash board. I remember this vividly as I recall another customer could not get the machine to accept payment via his bank card, so I told him if no cash he should try the app. I returned and then left Stennack within under 4 hours later.
The PCN has a picture showing me entering at 10.40ish then exiting 14.30ish
The PCN says I was in breach of their contract T&Cs so need to pay £100.
(seems this their standard scam).
As 2 weeks have past since our holiday, the car was cleaned and I no longer have the ticket.

WHAT SHOULD I DO?

They have not clarified what I'm in breach of specifically, nor provided a photo of the car with no ticket displayed, which it definitely was.

Do I use there own appeal process?
Seems that'd be a waste of time.

Also seems many people have suffered at Amtrac's hands, and bear trap threatening tactics.
How do we report and get them fined for illegal behavior.

Lee

I think people here will want you to show a copy of what you have received with all the personal info hidden (so no name & address)

They will then suggest that you read the top stickie on the board for all the instructions on what to do.  Frankly as someone who can read perfectly well I found it a nightmare so you may need to keep coming back to get more help if you can find your way through it all.

    But the basic rules are
    • don't pay
    • don't tell them you were driving (refuse to name the driver)
    • and should things continue to get to the "going to court" stage do respond to that within the required timescales.
As for not having your ticket - do you have proof of payment on a bank statement or similar?

I'm guessing that if they haven't said what the problem is that it might be that you overstayed instead of not paying?  The signs can be horribly confusing with you can only stay X hours on the fifth day of the month or something.

    Good luck!

Both sides please, redacting all your data.

Leave ALL dates and ties showing please. Without those, it is almost impossible to provide the correct advice.

However, the NtK is not PoFA compliant with regards to PoFA 9(2)(e) both (i) and (ii).

So, under no circumstances should the Keeper identify the driver

As above, with less redactions, plus BOTH sides, not just half of the letter you received. ( There is more information on the back. )

POFA worded IMHO.  The only bit missing from Sch4 9(2)(e) is 'and pass the notice to them' (debatable whether that's an instruction in the legislation or required wording).

I purchased a ticket at their machine (cash for 4 hours) then displayed it clearly on the dash board.
I am not for one minute suggesting you should pay this charge however unless something has changed recently paying for 4 hours (specifically 4 hours) doesn't seem possible at this car park.

3 hours (and 5 hours) are possible.  Could that be the root cause of the problem?

    Thankyou Dazed_And_Confused

Are you referring to the ticket machines on site.
How do you know this please.

Do you also know if you have to enter your vehicle number plate when purchasing the ticket. I seem to recall I did for my ticket.
So presumably Amtrac will be able to prove I had 3 hours or 5hours if that is the case?

    Parkopedia has the current options.

    https://en.parkopedia.co.uk/parking/carpark/the_stennack/tr26/st_ives/?arriving=202409290830&leaving=202409291030

And there is image (date unknown) with the same re 3 or 5 hour options.

    https://www.stives-cornwall.co.uk/services/stennack-laundrette-car-park/

And if you tried to use Ring Go to pay for parking today it's 3 or 5 hours, no 4 hour option is available.
