Car Insurance false claim
Hello,
I have purchased a car insurance with Marshmallow at the beginning of the month, and 3 weeks later, I get an email about them opening a claim as I allegedly was involved in an accident. They said it was reported few days ago, however I am fully aware I have not had any accidents. When I phoned up, their consultant said they couldn't t give me more details due to GDPR relating to the accident. However, I have gone through the security checks with them, and since I am apparently the only against whom the claim is made, I believe I have the right to know where, how or who falsely accuses me. They said they cannot give any details but they will investigate. I sent them pictures with my car from all angles, as proof of no accident. Unsure what is going on, but I feel like I will be losing sleep over this. I really want to know why they cannot disclose any details. Anyone had anything similar?
Thank you

Most likely to be someone getting the reg number wrong. I'd leave it to the insurers to sort out for the meantime, what would you be doing with the details of the claimant?2

The claim is being made against you, you are entitled to know what the allegations against you are, where it happened etc.
As others have said, there is often a case of registration plates either not being captured correctly, or written down by a witness with bad handwriting or a call centre agent capturing it incorrectly etc etc. Obvs then when they do the MID or DVLA checks it brings back the wrong vehicle, keeper and insurer.
Ultimately you need to know where you are going to need at a minimum location, date and time as then that gives you the opportunity to show you were on the other side of the country and you've got receipts from a shop there within an hour or two that substantiates thats where you were.
The other options are:
1) Cloned plates
2) They've randomly chosen a vehicle after returning and seeing damaged and somehow decided it was that car that did the damage
3) You did actually cause the damage and just didnt realise - more common with bus/lorry drivers where a light touch just doesn't move the 15t vehicle significantly2 -

It might not be a false accusation. It could be as innocent as someone someone miss-reading a number plate or something more sinister such as a cloned plate.I believe I have the right to know where, how or who falsely accuses me.Canon7601 said:
That proves nothing. It only takes a few days to repair a car.I sent them pictures with my car from all angles, as proof of no accident.
This can't move forward unless they give you more details. This cannot escalate without you being provided with the relevant information.Canon7601 said:
I wouldn't. You have not been presented with any evidence that you were involved. Only when (if) that happens do you need to take it more seriously.I feel like I will be losing sleep over this.3 -
Thank you everyone. I have followed this up, and called again. They gave me the address where this happened, apparently it was on the opposite side of London. So obviously, it couldn't have been me. I can present proof of attendance from an institution. However, I have presented them with only the photos for the moment( I haven't thought at the possibility that @MEM62 presented -hopefully we wouldn't go down this way). Apparently there was a collision between vehicles, but it is ridiculous that they have not matched my profile or the car's profile by now with the driver's to see that they have made a mistake.
Anyway, thank you everyone.

Hi all, just coming back here with updates- car reg number has been cloned. I have received PCN s and have informed the police, and the insurance/dvla. Problem is, the car that has my numbers is more or less the same as mine- model, colour, make from what I can make out in the pictures. I am really stressed right now.1

Sam Vimes' Boots Theory of Socioeconomic Unfairness:
People are rich because they spend less money. A poor man buys $10 boots that last a season or two before he's walking in wet shoes and has to buy another pair. A rich man buys $50 boots that are made better and give him 10 years of dry feet. The poor man has spent $100 over those 10 years and still has wet feet.
