Ford Finance reclaim

My mum is the sole executor and beneficiary of my late father’s will as she has started a claim as dad took out car finance with Ford. We did not need to apply for grant of probate at the time of dad’s death as everything was straight forward. We do not have the finance paperwork and ford are refusing to release this to blue panda unless we obtain grant of probate. They have a copy of dad’s will but are still refusing to release the paperwork. Are they right to do this? Dad died 2 years ago and his affairs are all sorted.

    They certainly are. 

    As for requiring probate, financial institutions can insist on it.

    How long ago was this finance taken out?

    Yes.  Any firm has the right to insist on probate.  Banks and investment companies often apply a tolerance but it is optional.

    We do not have the finance paperwork and ford are refusing to release this to blue panda unless we obtain grant of probate.
    Why had your mum employed an ambulance chaser?   This is going to a pretty open and shut situation and all CMCs are going to do is leech some of the redress, where there is some.  They are not going to be doing any work for it.

  • Frankly I would tell Blue Panda, that you are no longer pursuing this due to the cost of obtaining probate then forget it, the hassle is probable not worth it and you may spend money on probate only to find there is no compo due.

    Other than its probably on a no win no fee basis and so deciding to withdraw means you have to pay their fees
