APCOA at Heathrow demanding 80 quid fee !

Payment was attempted twice but payment site seemed to be malfunctioning. 
Sent an email but no reply.

Letter thru today demanding payment .
Their appeal email address doesnt work as well so email sent by ' the keeper' suggesting attempts was made to pay orginal fee.

Can these force outrageous fees ?

    Read the Newbies/FAQ thread. Hopefully the Keeper didn't blab the drivers identity. Just appeal on their webform, selecting "other", with the following, word for word:

    I am the registered keeper. APCOA cannot hold a registered keeper liable for any alleged contravention on land that is under statutory control. As a matter of fact and law, APCOA will be well aware that they cannot use the PoFA provisions because Heathrow Airport is not 'relevant land'.

    If Heathrow Airport's owners wanted to hold owners or keepers liable under Airport Bylaws, that would be within the landowner's gift and another matter entirely. However, not only is that not pleaded, it is also not legally possible because APCOA is not the Airport owner and your 'parking charge' is not and never attempts to be a penalty. It is created for APCOA's own profit (as opposed to a bylaws penalty that goes to the public purse) and APCOA has relied on contract law allegations of breach against the driver only.

    The registered keeper cannot be presumed or inferred to have been the driver, nor pursued under some twisted interpretation of the law of agency. Your NTK can only hold the driver liable. APCOA have no hope at POPLA, so you are urged to save us both a complete waste of time and cancel the PCN.

    I really wish they hadn't done that before posting here.  Also you can't appeal by email unless the NTK says so on the back.

    What address 'doesn't work'?

    It now looks like you cant send this address an email and its a link to.lodge an appeal, do you think its worth appealing bcz the keeper has stated that they are unwilling to divulge any information about who could have been driving that day.

    May I also add that they seemed to have made a mistake with their date missing out the 4 at the end of 2024.  ( 202)

    APCOA originally an American company now owned by Strategic Value Partners, only in it for the money, still trying to to rip off motorists as they always have done.
    Don't overthink this go with the advice on here, this company isn't interested in anything only cheap easy wins, anything more and they move on to lower hanging fruit.

    Of course it's a link to lodge an appeal; that's how the PCN tells you to appeal.  There is and never was an email option on the PCN.

    So that's what the keeper does and they simply use the words posted above by @LDast

    There is no legal obligation, whatsoever, for the Keeper to identify the driver. APCOA are not an "authority" of any sort. They are an unregulated private parking company. They cannot demand anything from you. What the Keeper received is simply an invoice for an alleged breach of a term in a contract by the driver. They have no idea who the driver is unless you blab it to them. They cannot transfer liability to you, the Keeper because PoFA does not apply at that location. The burden of proof is on APCOA to show that the person they are pursuing is the driver. They can't... unless the Keeper blabs it to them.

    The above appeal has been used hundreds of time and as long as it isn't altered and has never failed to get the PCN cancelled. So, please stop overthinking this and just get on with it and comeback and tell us when you get the cancellation notice.

    Not ignoring advice mate and i have taken advice from others and valued their knowledge and won 2 cases witn it  and with that im forever in this forums debt.

    I might have come across a bit unclear to you but i have had a running with this company before and i responded to a certain email address and they dropped the charge.
    Noted though i will respond to the link with the suggested wording you kindly gave me and will report back .
