Holiday booking in France Odalys price guarantee rejection

Hello, I was after some advice on how to proceed with a French company please.
We booked a trip to France through Odalys who have a lower price within 24 hours guarantee, which I quickly found a cheap option through booking.com

However their reply was: The cheaper rate was seen on the English and not French website so they will not honour it.

I later found in the small print of their T&C that you have to have seen the reduced price on a French website only, which I feel is discriminate.

 Is it worth taking further?

 Thank you 😊

No, any "price guarantee" is a contractual not a statutory right and so they are free to place whatever terms they want on it. It's common for there to be geographical limitations to price matches because otherwise they are taking on FX risk, differences in taxes, differences in consumer rights etc all of which can impact the price.

Discrimination is not illegal, only discrimination based on protective characteristics (sexual orientation, religion, gender etc) is without substantive evidence of differentiation to justify it.

Not discriminatory at all and completely fair and legal, you just missed the Ts and Cs.

Would you expect Currys, who price match, to do so with foreign websites?

    Nothing you can do.

No.  It's discriminating in the sense that they've drawn a distinction between the French and English websites, but not discriminating in the sense of it being unjust, prejudicial or unfair.  The company is free to set the terms and conditions of a price match scheme as they see fit as long as they are lawful, and I can't see that these are unlawful.

Why not just buy through booking.com at the lower price?

In UK law yes, though it would be French law which would be applicable here. Though I very much doubt that would help the OP any further.
