  • Please forgive ignorance if this is a silly question, but can you contest a discontinuance? I mean, DCBL put people to significant inconvenience and anxiety with these speculative cases, while being fully aware they're not going to see the cases through. So could you challenge the discontinuance and ask to go to court anyway, and make a counter claim of your own for costs of defending a case that the claimant was never going to pursue?

    No, you couldn't add a counterclaim that late. You can ask the court for costs but that's covered already (with two example links) in NEWBIES PLEASE READ THESE FAQS FIRST.
