Car DCA claim response

Hi, Ford Car Credit have responded to my claim saying they have made reasonable searches to find out if a DCA was paid but they ate not able to say. This sounds fishy to me as they have both account numbers etc. Is this just a stalling tactic to put people off claiming and should I go to the FCA now or wait.

    You presumably are aware that the FCA have deferred reporting on the matter until late 2025.

    There is nothing fishy, they do not have to keep records forever, indeed, per GDPR they are required to delete old data. If they don't have any record of whether they paid or not, they will not be able to tell you. Part of the delay as Hoenir mentioned above is because of issues like this where there is no data so they don't know what approach the FCA will take.

    You cannot go to the FCA, they do not take customer complaints and the FOS will not accept complaints while the FCA review continues. You do not need to worry about time bars as they are currently suspended.

    Wait until the end of next year and see

    How is that Fishy?
    The FCA themselves have said there are issues with contracts that are older than 6 years due to the data protection rules.

    Is this just a stalling tactic to put people off claiming and should I go to the FCA now or wait.
    why would they need to stall?   The process has been suspended until late 2025 at the earliest.    Lenders are not looking at DCA complaints until then (possibly later if court cases and appeals run into 2026 or 2027).  

    You cannot go to the FCA because its not within their remit.  If you meant FOS rather than FCA, then you cannot go to the FOS either because the complaints process on DCA is suspended until late 2025 at the earliest.
