NIP for speeding - Incorrect info on photo

I've received a Notice of Intended Prosecution for an alleged speeding offence but there's inconsistent information on the provided evidence. The letter states an offence of 21st August, but the photo has a date of what looks like 1st March (or maybe 3rd January if it's using a US date format)

Given that at least that bit of evidence is incorrect, is that enough to undermine confidence in the rest of the data? Anyone successfully (or unsuccessfully!) challenged on such grounds?

    Whilst you may be able to argue the date.
    Is that your car going at 83mph....

    It'll be in UK format, because it's in the UK.

    You can always consult a road traffic lawyer, but I suspect that if everything else lines up it's not going to be enough to get you off on a technicality. You can't claim that you genuinely think it's asking about the 1st March because the correct address is in the letter.


    Was the car in the location specified at 13:22 on the 21st August, doing 83mph?

    Have they stated that the date on the photo is the date of the offence? Could it be the calibration date of the camera?

    Aye, but if you extrapolate from there what other things aren't calibrated properly?

    OP was it you and were you speeding? 

    If so and you are eligible for a speed awareness course it might be the prudent way forward, you just never know how a magistrate/sheriff will go on this and will then be points and a higher fine.

    Ps I've just noticed that guys unfortunate name.....eek.  Is it real?

    If you can go for speed awareness course then this is much less risk.
    I find it somewhat ironic they do them on "zoom".
    Mine was £88 recently.

  • It might be a case of pointing the date on the photo out to them, in a "Wait, what? kind of way and they may drop it out of embarrassment. I'd consult the website above though.  If you do choose to query it, do it in plenty of time

    I think from memory the car would be in that approximate location on that day. I have no idea if the time is accurate as it was part of a much longer journey.

    And of course, for the record, I was absolutely not speeding.

    That's my concern, that if the date is wrong then what else could be wrong? This doesn't strike me as evidence of being a particularly well-calibrated bit of kit. I strongly suspect the time is wrong too as I think I would have been in that area much later than shown on the photo.

    Sadly a speed awareness course will not be an option as I believe I have had one of these in the last 2 years hence why I'm keen to avoid this. I was driving but - of course - was not exceeding the speed limit.
