PCN - Operator Asking for Address

I got a PCN in London from Parking Control Management (UK) ltd.

Parked the car at my friend's flat and went in to his flat. The first 30 mins is free but I thought I overstayed a couple of minutes when I found the yellow PCN. Spent anotther hour parked to see the concierge but they told me to check with the operator itself.

On their website it claims "No valid parking session registered". And the evidence provided was pics of the parked car taken only 15mins apart both within the 30mins the car is parked.

I naively made an appeal saying, I parked there and (:() the PCN was given within the free 30mins. No full name or address given. They replied via email  provided saying I didn't provide them a serviceable address to respond to and asked me to re-appeal with address for my appeal to be "considered".

Meanwhile, I've realised that I was supposed to book a session even for the free 30 mins which I haven't. Now I am uncertain what to expect if I give them my address and whether they have evidence of my overstay aftern the PCN. Do I have any chance using the template after my first appeal (or is it void as they don't consider it anyway). Please advise?

If it helps, I am from North of England and also additional driver on the insurance. The PCM is IPC and AOC member.

    If you do nothing they will obtain the keepers name and postal address from the DVLA database and post a PCN to that address. They wont accept any appeals without proof of who is appealing, so without a name and address 

    Unless you live in Scotland the fact of being up north like me is no help 

    You have zero chance of a successful appeal, no chance because there is no money profit in them accepting any appeal.  The appeal phase is merely to show that you tried, it wont result in the PCN being cancelled 

    Ideally you get the concierge or landowner to cancel the PCN ASAP 

    The insurance aspect is irrelevant, its nothing to do with insurance or driving licence or ownership, just the registered keeper and the driver

    Thanks for your response.

    Should I respond with my details but use the template instead of appealing this time? The operator is accredited IPC member and has AOC logo on them.

    My address is in Newcastle so wondering if that helps with defence as the Operator is in London. The registered keeper is my brother so wondering if I don't respond it would involve him and his time. I am catching up with all the posts in this forum and trying to piece together so apologies for using the wrong jargon.

    Both are in England, it makes no difference if you live in Newcastle or if you live in Kent.

    The template appeal isn't designed to work against IPC firms like PCM. It wasn't meant to!  But you clearly did have to appeal with your name and address. No matter.

    Obviously you just ignore them now, which you'll know from reading post 4 of the NEWBIES thread.

    I got a response to my appeal (online) and it has been rejected as you predicted. They quoted:

    "All parking sessions must be registered including the free period. If your registration is unsuccessful then please find alternative parking...

    If one is not registered, then there is no way to determine how long a motorist has parked. It is therefore imperative that motorist registered for the duration of their parking on arrival including any free period offered."
    And have given two options:
    1. Pay at the discounted amount of £60.00 within 14 days. Please note that after this time, you will be liable for the full charge of £100.00

    2. If you believe this decision is incorrect, the Independent Appeals Service (www.theIAS.org) provides an Alternative Dispute Resolution scheme for disputes of this type. As you have complied with our internal appeals procedure you may use, and we will engage with, the IAS Standard Appeals Service providing you lodge an appeal to them within 28 days of this rejection. For further information please visit www.theias.org.
    If you decide to use the independent appeals service, the offer of a discount for early payment will be withdrawn, and the full parking charge of £100.00 will apply for a further 28 days in the event that your appeal is rejected. Please note that the independent adjudicator is unable to cancel a charge on grounds of mitigation and the decision will be based on facts and evidence only. The IAS will also not consider cases where the charge has been settled.

    3. If you choose to do nothing, we will seek to recover the monies owed to us via our debt recovery procedures and may proceed with Court action against you. If no payment is received within 28days we may refer your case to our instructed debt Recovery Company and/or Solicitors, at which point the charge will increase to £170.00.

    If I understand you previous comment now, I am in Stage 2 (POST 3 of NEWBIES thread) but since this is with IAS I should not bother appealing with so move to Stage 3 (POST 4)? I believe this will be i 28 days since rejection.

    The next stage for you is the impasse stage, neither side budging an inch, so debt collectors letters, post 4

    After that its possible that you receive a Letter of Claim, followed by a court claim pack from the CNBC in Northampton 

    Both of the last 2 require response, but nothing in between 

    ( As for the current IAS stage, there would have to be compelling reasons for even trying it, few win there. )
