Lakeside Service Road

Hello Guys and Gals, I have been scouring the forum and reading for few days and I have to say my head is on fire from all the information lol

It's very well done and obviously you guys have put in a lot of work and I think I understand most of what is said and all that but just for reassurance and because I couldn't find a case that's similar to mine at all I thought it may be best to ask a question about it. I acknowledge it's that the process for all seems quite similar but because I'm not sure if I have grounds entirely I need to ask so please bare with me.

So Lakeside is managed by Premier park and then enforced by Gladstones it would seem.
I found quite a bit of info on them here it seems they are a regular scam company and all that but if you wouldn't mind explaining some things quickly I would really appreciate it and will put my mind to ease for next steps.

I have received a Pre action protocol letter which I was trying to find some info that's in the last year or so and couldn't, I'm not sure exactly if it's a LBC letter as it says and I quote "We write further to our letter before claim"
Also I seem to have missed a few letters and they also seem to be coming late, literally received this one yesterday but it's dated 9th of August and few days ago I received a LBC from them for a different vehicle also dated before which 14 days expire today technically. 

So with that information in mind let me give you a quick explanation of the situation of the parking fines.

So I work as delivery and have been for years, like food delivery and we have been parking in the service road there for years too, some for long periods of time and some like me for only the amount necessary to just go pick up the food and then leave. They don't have a dedicated parking for us and never had. There's a right side of the road where you can park supposedly now without problems but normal people park there thinking it's fine and unless we're lucky for there to be an open spot out of 4 in total we have to use the left side and for us there isn't really space there unless you're a motorbike then you can obviously fit in the gaps between cars on the rightside where the 4 spots are. Mind you like I said this was never a thing or a problem whether we were parking left.or right side. Now the left side technically is the service road but the sign says is for delivery partners and all that and although I'm not directly partners with Lakeside I am servicing their restaurants and it also the sign says 20 minutes maximum stay etc. I'll see to provide you guys the sign a bit later.
So it seems they have started to ticket people for nothing so to say and I do talk to their enforcement team seeing how I've been doing this jobs for years we know each other and they always tell me hey dw go pick up and leave we won't ticket you because I don't linger I'm really quick in the few minutes most of the time ,rarely 10-15 and almost impossible 20 min delay since it depends on the restaurant to prepare the food and pack and give it to me sometime they are busy so there's some delay but not in the half n hour range no.
But like I said it would seem that despite that I have received few of them some directly to LBC (1) PAP and few are from premier park one or two new ones from the past month or so,despite people telling me they won't ticket me and me being quick. Most definitely nobody has waited 20 minutes to give me ticket and there's no time stamps as waited period from 18:00 to 18:20 for example etc.
So yesterday I went in their center management but couldn't talk to the big boss so to say just some manager of theirs that deals with something completely irrelevant and she said to me "oh you shouldn't be parking there go.to one of the other 200 spaces that are 5-10 minutes away walking distance" which obviously is detrimental to my job as they'd flag me for time taking too long and etc which is why literally no other driver does it let alone the motorbikes. And she said the best she could do is file appeal with premier park on my behalf to which I said that just sounds ridiculous considering you're employing these people and they work for you. They are Savills I believe and premier park issues the ticket and Gladstones seems to be the solicitor. Anyway so I left but I'm still thinking of example A talk to whoever runs the land which is Lakeside Intu but who's the boss to talk to them about and what will I really formulate as I'm not really an angry customer lol I'm not sure need advice on that and should I reply to the LBC and PAP letters now seeing ones date of 21 days expires now and the other in 2 days or so at the 23-4 or should I try to reach the management team again asking them to cancel etc.

This is on 3 different cars it would seems since last year November maybe. Use to have a peugeot, then a mercedes, now another mercedes.  You know delivery jobs cars change to the most optimal etc.
Sorry for the long post I'm just trying to give as much information as possible seeing how I couldn't find such case as mine. Also on the other side they have another car park where they specifically made only motorbike parking and we the car drivers share with the customers parking but that's literally the other side of the building so they definitely didn't help us in anyway.
Anyway plan A still or trying to respond with specific template to the LBC and PAP letters which are for two different cars and the third one only has a premier park letter which is new from. The last month so for them I'm not worried if the Lakeside management decided to cancel I'm sure they are fine to ignore for now.

    ALWAYS plan A, get the managing agent to cancel all of them due to legitimate loading or unloading, especially if it is JLL or Savills or similar at the Lakeside 

    Ignore debt collectors letters, post 4 in the newbies sticky thread in announcements 

    Do not ignore an LoC or court claim 

    You can appeal any that are still within the appeal period, especially if Jopson versus Homeguard applies, loading or unloading, not parking per se

    Alright so just to summerize, I need to find out who's the managing body of lakeside.  I think all their employees in the management center have their emails finishing at savills so perhaps it's that one.
    And the LBC that expires today the 14 day that I have been given but only received it few days ago I ignore until I receive a letter of claim? Or I send them the template through the mail that's in the newbie thread that's automated. (Image removed by Forum Team)

    There's no 14 days on a LBC.

  • Hello, yea sorry was my bad you're right my head was on fire from all the information and thinking which steps are right to take.
    So few quick questions. 

    1:I contact the guy from the photo center director or he's not the guy I should be talking to?

    2:as I'm not a customer the customer complain won't work so how do I complain properly what do I say for my case how can I complain as a delivery guy haha.

    3: The PAP letter says 14 days for payment it wasn't for anything else but it says and I quote "The PAP period has expired and our client is not prepared to enter into further correspondence etc" receive payment in 14 days or client reserve right to take you to court. So I take it I don't do nothing since they said they aren't interested in correspondence with me? If court letters come then I address it?

    4: The LBC says "You should do one of the following within 30 days"
    Pay or dispute 
    So I dispute it through their email if I have understood correctly? Or I don't bother as it isn't a LoC or a court claim?
    Thank you again for your help I'm trying to keep it short and simple sonit doesn't take too much of.your time but trying to be reassured as well without me having doubt that I tool the wrong information cause I didn't understand.

    Complain to the agents who run the retail park and ask if they really want to make this site a no-go area for deliveries, or will they kindly step in and cancel the PCN to restore your faith.

    And finally please can they explain how to be whitelisted to avoid this happening again.

    I just received a letter of claim lol from 14 but I got it today,anyways they claim about September 23 and December 23 they combined two pcns into 340 outstanding balance. BWLegal is the solicitor or whatever.

    You could say the same about their letters of claim. 

    This is them trying to be "reasonable" as if it's a real debt that actually exists.  The only resolution they want is for you to pay in full or set up a payment plan.  The only resolution you want is to pay £0 so there's nothing to have a "meaningful discussion" about.
