Fuel theft by Driver not registered keeper

I am new to the forums! Please let me know if I'm in the wrong place for help
I am asking for help on behalf of my husband who was the registered keeper of a van that was sold to a man that brought the van but due to the loss of the V5 and having to pay and wait for a new V5 the van was still in my name... The driver of the van took fuel from a petrol station but he didn't pay for it.. He brought food and then drove off! My hubby was then  informed via letter by a company that said he needed to pay for the stolen fuel so he explained he wasn't the driver so then debt collectors sent letters asking him to pay for the fuel and to pay debt fees but because he refuses to pay for the fuel because he's not the thief, he is now being taken to court! He has disclosed who the driver is and yet they still say he needs to pay as he was the registered keeper but he does not own or drive the van... Does he  have to pay for the fuel and the debt fees? We really think it's unfair because he didnt steal the fuel, he didn't decide to fill the van up and then drive away without paying for it! We would really welcome any advice please as we are not in a  position to pay for this, we struggle as it is.... Thank you

    Show us the claim form (redacted of data, the VRM, the MCOL password & Claim No).  Which solicitors and who is down as the Claimant?

  • Hi there.. Sorry for late reply! Thank you so much for helping me. The solicitors is DCBlegal and the Claimant is Vars Technology Ltd.. It's a small claims track..

    No one can help you otherwise

    Redact the front page of the claim form, so hide the name and address and the QR code, plus the VRM details on the left, and also hide the reference number and password on the right, then post a picture below, then post a redacted copy of the defence that was logged. ( Must have already been done because your picture above is the DQ form. )
  • Yes I did do a defence because we panicked and wasn't sure what to do but I think this is the claim form you mean 
  • I haven't got the defence paper because I sent it off.. But we said that my husband wasn't the driver of the van and that he didn't steal the fuel and we disclosed who the driver was.  Have we done wrong?
