I appealed a Group Nexus postal PCN parking charge using the newbie thread but I'm not sure how to proceed with their response. I was hoping it would be a straightforward appeal as the NTK was more than 14 days after incident.

 - DW parked in Tesco car park on 05/06/24 and used the Tesco Parking voucher. The machine must not have registered it. Received a Group Nexus PCN in the post on 10/07/24. Date of Issue on the PCN was 04/07/24. So I appealed using the newbie template on 22/07:

"RE PCN number: XXX I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner. There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle. If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it. If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner. Also, since the Notice to Keeper has been sent out more than 14 days after the alleged incident, this would be a straightforward winning appeal at POPLA"

 - Received a PCN reminder on 22/07. I Ignored this as my appeal had already been logged.

 - Received email response to my appeal from Group Nexus on 13/08:

"Dear Sir/Madam,
Thank you for your correspondence relating to your Parking Charge.
The representations stated in your correspondence have been noted and considered. Please forward to us the full name and address of the driver at the time this charge was incurred so that we can update our records accordingly.
We are placing this Charge on hold for 14 days from the date of this email to allow you to provide the details requested.
Yours faithfully,
CP Plus Ltd"

How best to proceed? Thanks in advance.

Please stop revealing your intellectual malnourishment by asking me, the keeper, to provide you with the drivers details. You know very well that I am under no legal obligation to identify the driver and I decline to do so.

Just get on with your job and either cancel the PCN or issue me with a POPLA code where you know you will lose or auto-withdraw like old fashioned birth control.

  • Thanks will do.
