It applies to the situation explained in the 3rd paragraph of the Template Defence.  I take time there to explain which cases use the Chan images.

  • I now have a CCJ, Claiming I did not respond to the claim form.

I acknowledged the MCOL and submitted my defence within the specified time. I also had acknowledgment of that. I didn't hear anything following this stage.

    How has this happened?

Contact the CNBC and ask them what has happened. There seems to be a big problem, and you are not the first victim to fall foul of this. I think other posters who have suffered this have said they received about £250 in compensation.

This assumes you got acknowledgments when you completed the AoS and submitted your defence by email.

Hopefully the more court savvy regulars will be along soon to help.

Should I have seen confirmation of defence being filed here?

Defence was submitted 23rd August and I received an immediate automated response.

You would expect to see a line there stating when your Defence was received by the CNBC.

As you have an email acknowledgement of the Defence email being received by the CNBC, you need to show that to the CNBC and 'encourage' them to put right their obvious mistake.

Yep, happens all the time.  Complain!

@Pat_Burger got £250 compensation and an apology; so did some others.

  • I phoned CNBC following the last posts. The person on the phone kindly told me to resend the defence with proof of the original email and automated response, and the judgement should be set aside. I did so.

I have just recieved a mostly copy and pasted response saying I need to complete a N244 costing £303.

please advise, who should I be complaining to?
