Urgent advice needed please

Hello,

I have exhausted every avenue i can think of and really need advice from anybody that may be knowledgeable, this has been going on since winter. I'll try and keep it  easily readable.

I ordered 800l of LPG from Calor - it was all I could afford and calor had me at a criminal rate of 90ppl

They delivered a full tank by mistake - from empty to a full 2000l tank

Called calor, they admitted their error said they would adjust the bill to only reflect what I ordered

No sign of adjustment, called calor again of course this was incorrect information but this person didn't have a clue either. I asked them to extract it, he said that would be very difficult for them. Then said if I am moving soon the next household will get the gas credited but if I am staying I will have to pay for it, I don't want to pay for a full tank of gas at 80 odd ppl when I could order from a competitor at half the price

Put in a complaint via email.

No response after two months, went to ombudsman

4 months after initial complaint email to calor, calor respond saying they will extract the gas. Then refuse to talk to me any further and will not extract gas because complaint is with ombudsman but says bill will be on hold.

ombudsman decides in calors favour, despite calor never submitting any response to them because there was no proof of over delivery from me. Even though I would have happily supplied any proof if they just asked for it. Rejected their decision

Now I've had an email from DRADigital chasing after the payment for gas I have not ordered. At this point I am about to pay it, as I do not want my credit file ruined but it is like demanding someone pay for a diamond ring they didn't order.

My thoughts at this point are to pay it and then continue with the case, possibly to small claims after but people are warning me that by paying I have accepted delivery. Can anybody offer any advice please?

    It seems unusual you wouldn't supply the evidence to the ombudsman when you raised your case with them. How else would they be able to evidence the claim

    I provided the details of my complaint along with all of the emails I had sent to calor. I didn't realise it was my one and only chance to supply all of the documentation I had. This is not a process I have done before. If calor had at least responded to them then there would have been no need for that documentation as the over delivery has never been in dispute by calor. We can't all be perfect and it does not change the fact that calor are at fault.

    This is an old thread and now hopefully resolved but.........
    The problem with not paying is that they will escalate and you will end up paying legal fees and having a possible judgement against you. I would pay the money and then as you say, go through the small claims process.
    On another note can anyone let me know of any ombudsman/monitoring process that has ever served the public interest? I find they are entirely hopeless, a waste of energy and put there to absorb complaint energy with little chance of a positive outcome.

    Thank you for replying. I never came back to this thread after the first response was victim blaming.
    In the end I negotiated a very small discount as sadly I did not have the energy or time to fight it further but it took almost a full year just to get that far. They have recently been in the paper for doing the same to other people

    Not a true ombudsman as part of the pay to join trade association and many firms are not in that group and so not bound.
