Hi All,
So the other day I got a letter from DCB Legal, Letter of Claim for a parking ticket I knew nothing about. As it was a legal claim and not just a charge notice I e-mailed them asking what is going on.
They responded saying I was parked on a private road and that they had sent me charge notices on the 16th or April and 30th of April and that I had not responded. The charges have gone from £40, to £100 and now to £170.
I moved home in March and therefore my address was not up to date with teh DVLA, something I did in April but clearly it didnt come back in time for DCB.
Im not looking to argue the parking charge. I visited someone at a private residence and didnt see the sign for Private Parking, the issue is, I didnt know anything about it so how can i pay within 14 days if I dont know anything about it.
How can I fight this?

Have you since updated your V5C with your correct address. Updating your drivers licence with the DVLA does not automatically update your V5C with the DVLA. Also, you need to urgently send a data rectification notice to the DPOs of both DCB Legal and the Claimant and order them to update their records with your current address and to erase your old address for service. The highlighted words are there for a reason... use them.

Yes, both licence and V5C were updated in April but they come back at teh end of April, AFTER these guys sent out letters to my old address.

They have my new address as the legal claim came to my current property.0

Send that last item Ldast referred to regardless, because you dont want them sending ANY future paperwork to the old address, especially a possible future court claim, its been known to happen, a default CCJ is harder to unravel and a lot more costly than a few free emails
You have the legal right to email a DPO with the new details, use that legal right to circumvent underhanded tactics by the claimant2 -

That's the point. Use the word ERASE.
Which PPC is their client? If it is a BPA member, tell them to comply with the BPA CoP clause 23, pause debt recovery and set the case back to appeal stage, as that clauses requires.
You won't be paying, by the way. At all.
Not even if they refuse your right to appeal and certainly NOT if you get a court claim form. And don't offer to pay the reduced charge.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Any way. Does the BPA Code pause debt recovery 23 need to go to the parking company, or the debt collectors legal team?

when I searcg for BPA Code pause debt recovery 23 it doesnt bring up any forms, just lots of threads of people saying use this. Can anyone point me to the form?

Try a Google search for BPA Code of Practice and then when you find the document, look up section 23 of that CoP.1
