I’d be grateful for any comments on this proposed part of the defence:
The facts known to the Defendant:
6. The facts in this defence come from the Defendant's own knowledge and honest belief. The Defendant is unable, on the basis of the POC, to understand with certainty what case, allegation(s) and what heads of cost are being pursued, making it difficult to respond. However, the vehicle is recognised and it is admitted that the Defendant was the registered keeper and driver.
7. The vehicle was parked whilst the Defendant visited the Rose of York pub, Richmond-upon-Thames, but the Defendant did not notice any signs, other than a prominent blue sign at the entrance showing “CAR PARK FOR PATRONS ONLY”. The Defendant therefore believed that she was entitled to park whilst patronising the premises.
8. Following receipt of a parking charge notice, the Defendant complained to the manager of the Rose of York, who immediately agreed to cancel the parking charge and stated that the parking company would no longer contact the Defendant. These emails will be exhibited.
And then later on in the section about landowner authority & lack of ADR:
32. It is clear from emails sent by the manager of the Rose Of York to the Defendant, that this claim has been issued contrary to the landowner’s instructions.
32. Following the assurance by the manager of the Rose of York that the parking charge was cancelled, the Defendant did not file an appeal with the parking operator and was therefore unable to take advantage of the independent appeals service, thus being denied the opportunity of Alternative Dispute Resolution.
Thanks very much

Yep looks good. And from the Template, I'd remove ALL the stuff about the DLUHC and the draft IA - it's getting old and I will be removing it from the template in a few days.
Basically take out the old waffle about that!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi,Just got to the point of submitting the defence but unable to login to MCOL as password is not recognised & no obvious link to reset the password.
Can anyone offer any advice please?0 -
Yep you've mistaken I (capital eye) for lower case l (ell) or number one. Or 0 (zero) or O (letter oh). Your Password DOES work.
Are you using the new short template?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
