Directions Questionnaire HELP!!

Folks!

I've read all of the newbie info and followed it with diligence over the last 4 months in a battle with Excel Parking Services & DCB Legal!

I've received a Directions Questionnaire from CNBC and tried to follow @bargepole's advice on this thread https: // forums  .moneysavingexpert. com/ discussion/ 5546325/ court-claim-procedure-updated-october- 2016/p1 but I think I have been sent the wrong forms by the CNBC. 

I have a Directions Questionnaire (Small Claims Track) but it looks nothing like this one that most people reference. https:// assets. publishing.service. gov.uk/media/ 66a8b019ce1fd0da7b592f43/ N180_0724.pdf

It has also been partly prefilled to force me into the "Small Claims Mediation service" as the document arrived in the post (when I was on holiday) with the "No" scribbled out and the "Yes" firmly ticked.

Do I:
a. contact CNBC and check that the correct form has been sent to me and query why it has been pre-filled to ensure that I go through mediation
b. download and complete the N180 form from gov.uk
c. return this form and accept mediation

HELP folks please! I intend on defeating Excel and DCBL but need some advice here!

    Are you looking at the claimants copy of their N180DQ? Are you following the 12 steps in the list from the Template Defence thread? What does your MCOl history say? Have the CNBC sent you an N180 DQ?

    The info about the DQ in the Newbies/FAQ thread is out of date. The form has gone through a few iterations since that was published. The latest form, for claims that were issued after 22nd May 2024 do not give any option to avoid mediation.

    Mandatory mediation has come up time and again on here over the last few months, its either fill in the latest form, or the downloaded new pdf, same thing, meaning that you accept mandatory mediation, or you risk falling foul of the new rules, even though your claim may be before the changeover date in may , read this thread

    No it's changed but only recently. Just search the forum.  Easily found.  Loads of chat about how to waste 5 minutes on the phone complying with this daft idea and not be bullied by a Mediator into thinking you have to offer money to a scammer.

    I haven't updated the NEWBIES thread yet because we still have people whose claims pre-dated 22 May when it changed.  The last thing we want is people thinking that Mediation is compulsory in the older cases where it isn't.

  • Folks, a but more advice please...

    Mediation was supposed to happen today. I was waiting. Phone on. No phone call. I've now had the obligatory standard email response saying I didn't attend... 

    Do I await a court date now?! Is this now not in my favour?!

    You need to email them back and say you waited in all day, had good reception and never received a phone call.

    You don't want the judge throwing the case out when he reads the case file and it says you didn't attend.
