Delayed but happy update.
My Sheffield case was discontinued, I found out by ringing the court to see if the hearing fee had been paid. VCS didn't inform me, and sent me a letter after the discontinuation stating they had a strong case, trying to settle and threatening me with an extra £200 in legal rep fees! Jokers.
My Leeds case went ahead, and I won! Well, I didn't have to do much, the judge struck it out due to the vague particulars of claim. He took particular issue with the particulars of claim stating "failure to purchase a parking ticket", when I clearly did! I successfully argued unreasonable behaviour on their part and was awarded £99 in costs.
What happens next? My case was a couple of weeks ago and I still haven't heard anything. I'm assuming that I'm waiting for Leeds court to issue the strike out order and details for VCS to pay the costs?
Massive thanks to this forum and all it's contributors, in particular @Coupon-mad. A great resource for fighting back against these scammers. We have also been in discussions with the local MP regarding my case and my colleagues cases.4 -
So, the strike out order has arrived in the post today (dated 14th February).
How will they pay my costs and how long do they have to pay?1 -
They will probably send you a cheque by early March. And did you read the MSE Article by Emily White yesterday about the banning of the (rogue practice) 'pay within 5 minutes' rule? Also in various press articles.
When was your hearing? Excel and VCS have known about that rule change for 6 weeks at least, so if your hearing was recently, it just shows that they aren't dropping cases and seem to be hoping victims and Judges don't know that claims like this have been deemed unfair, and the 5 minute rule is banned in 2025.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
